Self-Employed or Employed

Any employer worth their salt will respect you wanting to protect your own interests. @Highland Mule is correct in what he says. There is also a legal position here that an employer MUST follow and it appears they haven't . If in the next 6yrs they get a HMRC inspection and they discover that the rule of law has not been followed then there will also be implications for you. The law is .....and I'm happy to be challenged, that it is as much the employees responsibility to make sure the law is carried out as much as the employer. .....
Take the advice given and see Citizens Advice and cover your own back !
Fair enough, thank you for explaining. Will definitely contact citizens advice.

After the first week he told me that the rent is taken out before it goes to the HMRC so I don't have to get taxed on it. Probably because the accomodation isn't strictly legal. No council tax or anything. Just converted shed at back of the farm

Sounds like a case of modern slavery, which the Police are taking very seriously these days (y)

So your all basically saying is to run and get out of here asap?

I would have vanished at the least convenient time possible, even if it meant staying with friends for a week or two in a different county.

I'd also consider making use of Freedom of Movement, while we still have it.

First job is to get the passport renewed.

As others have said, no way is your current employer playing by the rules re holiday and sick pay although it will be intresting what your final payslip has on it .
I wish you luck in finding another job and it sounds like despite your age you are very employable but being laid off should hopefully be a positive move for the future as you were being badly treated. Please let us know how and where you move too.

You should get a P60 from HMRC (but through your employer) when your employment is up.

You will need that P60 for your records, especially if you do any self employed work during the following tax period.

Employer should provide you with a P45 when you finish which should record all details of pay, tax and nic you have earned/paid in the 2019/20 tax year.

I have been offered up until may 2020 a tractor driving job for a contractor but only £9.50 or something with £300 to share a bunk bed with someone. Not sure wether it would be worth it since it will take around 3 weeks to pay off the expenses to get to and from NZ
I'd be on a plain already. More to life than money the cost of the flights are nothing compared to the experience of working in a different country.

Yeah, if I don't get up going which is more likely this year anyway, it's definately something I'll look into another time while I still have the chance (no kids or wife etc). I'm in talks with people over here about jobs but got nothing secured yet

Just a bit of an update, found myself a new job on a grassbased dairy farm. Really nice boss to work for (even cooks tea some nights for me which is very nice). Good hours (plenty of time off and plenty of work when wanted), really good money which is a bonus. Just that it's in scotland, 4 1/2 hours from home ? Thanks for all the help, just waiting to get paid and get P45 from old 'employer' although he's been ignoring me. Hopefully once that's sorted, will have better luck hopefully. Oh and I get a slightly bigger accomodation for only £100/m instead of £100/week

Well i was about 2-2 1/2h away at my old place so although it's an extra 2 hours, doesn't really bother me. The drive is a bit annoying (going home for Christmas tomorrow for a few days unfortunately) but nah, I like the distance tbf, family drives me nuts ?

Will do. So far from what I've done and been told I'll be doing, it's my ideal job and could spend quite a few years here tbh. 40 point rotary, 1h milkings in the winter (Do a few milkings a week in winter) and 2h in summer (once a week Milking) so nice fast milkings and not twice a day everyday so enjoyable. Do all the feeding for the 450 cows, will be doing all the tractor work which contactors don't do such as spraying, fert spreading, bit of mowing etc so lots of variety, get both machinery and stock work. £10 base and £13 overtime after 39hrs so really enjoyable job and bloody good money for my age to go along with it

Pleased you have landed on your feet!
Learning from your last employer, you need to make sure you have a proper written contract of employment which sets out clearly the obligations. This is to protect both sides. It should detail a 6 month probation period.
The sooner you do this the easier it'll be, the longer you leave it you'll end up like last time. Proper wage slips, paid straight to bank, you should automatically be enrolled on a pension too (the standard one is usually pretty good - say yes every time to that).

Yeah, gonna sort all that out begining of next week. Will make sure to get a contract sorted and all that. My previous employer is still ignoring me after 2 messages and about 3 days or so. What would be the best way to go about getting wages and P45. Only asked the question of when I would receive both, and said I'm assuming I'll get it at the end of the month but no reply, even tho it's all done politely and not demanding anything.

Are you still owed wages? That's a worry.
First thing to do is make it absolutely clear to your former employer what you think you are owed, why and when it's due. You then need to give them time to respond, when it's a week past the due date it's time for a follow up reminder.
Not having a P45 is no more than an inconvenience, your new employer will put you on an emergency code which means that you may well have more tax taken now but it'll be squared up by HMRC at the end of the tax year (end March). If your previous employer wasn't making proper returns to HMRC then it's worth informing them. They should investigate and with a bit of luck apply backcharges and penalties too, you aren't in the wrong so don't worry they won't chase you, it's always the employers who is liable.
