I'd probably just walk away at this point. Your time and energy is probably better put to use in your new job. And sooner or later he's going to get hacked off with you pushing him, and he may turn out to be the vindictive type...

Chalk it down to experience, learn what you can from it and move on.

Happy new year; make it a good one. (y)

(Easy for me to say. I'm not the one who feels hard done by...)
If im being honest, I'm not going to miss £500-600, not to say it wouldn't help though. The reality is that there's not much to lose, except from £60 if it goes to small claims court and fails, and obviously a bit of time but that's no bother. Hes being a d**kh**d, not paying what is owed and that pisses me off more than anything else. I don't work purely for the money, I work to enjoy it more than anything else but obviously money is important and theres a significant amount which he's pocketing. If I don't get this money, my total lost amount of money will probably come close to around £1300-1500 between 3-4 farmers

With the small claims court, is that done at my local court or can it be anywhere? It may be worth doing it near me since it's about 5 1/2 hour drive without any breaks so a lot of effort for him

If your fairly sure he's been shafting you, get him dobbed in to HRMC, If he's done it to you, he's probably doing it to the rest of the staff.

You really should get your contract sorted BEFORE you start work - too late again now - and if they are suppling accommodation, inspect it with them and take photos etc before you move in.

Every new job is good at the start, its important to get things squared away early though in case it starts to go down hill.

I wonder if your old boss is on here? ?

Money wise it's all ok except from statutary holiday and sick pay which he doesnt bother with. There are a few things I can get him done for, reporting the accomodation would cause a big blow.

Well I did a week trial and just been waiting for his dad who lives on another farm on the Isle of Man to come back (he is now) but all will get sorted by the end of the week. Going to make sure I get a contract, even if I have to write it up myself just to add some protection for both sides and makes clear of expectations.

I don't think he is, have searched his name but don't see him. If he sees this then good for him

So you’ve left 4 farmers under similar circumstances?

You’ve posted your boss’s name in the screen shot of the messages ‘Stephen’ and then on the time sheet there’s the word ‘Gough’ which may or may not be his last name or the farm name perhaps.
Maybe just maybe you need to wind your neck in a bit as you come across as a cocky 18 year old I’m afraid. If this goes to court then this thread could be used against you as defamation of character. You don’t know for sure about the living accommodation because your not him.

Sorry to hear that I come across that way, certainly not cocky, just trying to get the right pay. If it goes to court, it's unlikely that this will be seen but if it foes, there's not much that can be used against me. And all is true in this thread, tax issues which was figured out, no holiday pay, sick pay etc which is true, rent being taken out pre tax which is true. It's all true so not lying about anything. As to accomodation, what do you mean? The other farms I've had issues with were mostly not paying after doing a trial and just deciding it wasn't for me

Already gone. 320 miles away so should be far enough. What's to lose chasing it
As I say, he may be the vindictive type. If you hack him off too much - by posting his name and profile pic on the internet, for example, or getting HMRC onto him - then you may find that your new employer gets a phone call about what an arse you are. Not saying you are an arse, but mud sticks.

I know anyone looking for a job here that left their last job under a cloud would be treated with great caution. It indicates an inability, or unwillingness, to resolve conflict amicably. Conflict resolution, or de-escalation, is a really helpful skill when working in a small team with someone, possibly for 300days a year, possibly for 12 hours a day.

Like it or not TFF is a bit of a virtual jobs board; it's everyone's professional reputation posted right here in public, in perpetuity. So far, all I know about you is you can't resolve conflict amicably, you're unwilling to swallow your pride, and you are indiscrete.

On balance, do you think this thread is helping your career, or harming it?

There’s your cockiness again I’m afraid by stating ‘If it goes to court, it's unlikely that this will be seen but if it foes, there's not much that can be used against me’

If you’ve ever been involved with courts then you wouldn’t make such bold claims. It’s just your age and lack of life experience I’m afraid.

Removed any info which if all added up could lead to him now. It's not like I've not tried to resolve nicely, he's decided he's not wanting to sort it out so what else am I suppose to do. Pride, I'm not bothered. If pay was sorted out, id leave it at that. Only reason I've posted here is for help and advice in a messy situation. Career wise, take a fair bit to link me to this account and even if you could, suppose slightly harming it but it's just a whole mess.

Interesting perspective. I see an employer who flouts the law - maximum working hours, lack of contract, holiday pay, probably habitation. I see a brave young man who is trying his best to stand up to an arrogant tyrant. Perhaps you’re less than fully comfortable with workers actually being given their statutory rights?

Only mistake I can see the OP having made is starting work without the contract in place, and not challenging the bully sooner, but that’s quite understandable, in the circumstances.

Fair enough. Good on ya for seeking advice if unsure; positive indicator as far as employees go. (y)

(It's not really linking your real self to your TFF account that's the issue. It's that to all the many thousand farmers on here - potential employers, colleagues and maybe even employees one day - you *are* that account. I've made some really good professional contacts through this place, and some great personal ones too. I know more farmers that I've met through here than in real life. I know my unintelligible username is important to my career, so I try to create the right impression with things that I post. You came here for advice; my advice is stop posting on this thread, and suck up the loss. Make of it what you will.

Whatever you do, I wish you luck getting it all resolved to your satisfaction. It's certainly a shitty situation to be in. Hope it doesn't tar your view of all of us Wiltshire folk.)

Yeah fair point. Obviously I would prefer if all of this wasn't public however if this never came about (initially started as employed Vs self employed until people noticed things off with my emoloyment) then I wouldn't be aware about half of my entitlements and where to even start. I don't want to be in this situation, I don't want to pee the old boss off but I can't just let people pee me around. If I may say so myself, I've been very fair to people I've worked for (have gotten on really well at the 2 places I spent some fair time at, one of which wanted me to go full-time there) and not caused much bother at all. Am I the fastest, no, do I atleast try to do a good job, of course, do I require much time off and sleep in all the time etc, no. Not to say I'm the best employee ever but I haven't caused much trouble at all, just gotten on with whatever I've been told to do. But it has to work the other way, im here to work and I expect to get looked after both financially and having time off, sick pay, holiday pay, contracts and all that lot. I have learned that a contract is an absolute must so that won't be happening again. I just can't leave another farmer taking the pee out of me, this is enough money to be worth chasing and he hasn't been fair to me so why should I let him take advantage of it. I'm sure there are plenty of good farmers in Wiltshire so don't worry ?

not read the whole thread but just thought I would say I was self employed for 15 years and now employed with a large company.

would never be self employed again and wouldn’t advise people to be either. You have to charge a lot of money per hour to make a decent wage being self employed, you have to find the money to pay the mortgage when you have a holiday and the worst part is....

you have to make sure you have the lump sum to pay HMRC. I struggled every year to keep on top with it and not through fault of my own, it’s just a large amount of money to find/save if you aren’t charging enough.

now employed I have healthcare, pension, shares, sick pay, paternity and holiday pay. Very lucky but the potential is out there with being employed

The more you charge the more tax you have to pay so it’s chicken and egg.

I quite agree yes but also totally depends on your expenditure as well. I tried to invest as much as I could afford to bring my tax bill down but it got to the point where I couldn’t anymore.
