Taking the brakes off single axle trailer?

Simple question- I've a small 7ft trailer that often isn't used, as we've got triaxle flatbed etc.

Consequently, the brakes are seized. A lot. Would it be permissable to whip them off, so long as the sub 750kg limit is observed?

Does it not depend on what it's plated to carry, rather than what you actually put on it?
