What about a disclaimer sign by where the people get on stating that they do so at their own risk. They can then decide to ride or walk. From my experience people love having a steady ride on a tractor and trailer. We have had the same problem in Round Table with the Santa sleigh which people have always rode on between villages. We have mounted a disclaimer sign after taking advice to allow this to continue.
Such a disclaimer does not absolve the operator of their duty of care or the need to comply with H&S/Legal requirements. PLI cover would still be essential in the event of an accident occurring.
 
It'll be a pity if H&S puts the kibosh on your idea @Foregoneconclusion . One of our local agricultural shows, Newport, in Shropshire, use tractors and properly modified/constructed trailers to transport the General Public from their car parking area, to and from the show itself. This involves running up and down a steep bank throughout the duration of the show. I'm not sure it still is, but Newport Show used to be the largest one day show in the country, and I'm struggling to believe that they would use this method of transport if it wasn't legal, lawful and insured?:scratchhead:

@Foregoneconclusion are Folly Farm anything to do with fish week? Sponsorship etc? They might still have the old trailers for the tractor and trailer rides and may be able to advise as well. The drivers had to be over 25 to cross the main road but not sure of the other details.

I have been to a couple of tourist attraction farms or farm visitor centres where they either have a tractor and trailer tour, or have the main car park away from the farm and visitor centre etc... and therefore use a tractor and trailer to get people to and from the farm and car park. There must be some legality as they do it everyday.
