Well we cannot go to a appeal thats all sewn up. So now its all down to the SFO and FCA. Not bad the court deciding we have no loan contract yet the 30k they gave us will cost use 190k. And they call that justice. Its a pity no one is interested in fraud any more.

You are right, it seems no appetite for investigating let alone prosecuting fraud. What a contrast to allegations of sexual misconduct where it seems that complaints no matter how old or difficult to prove are readily accepted for investigation.
These matters are serious for the victims and cause suffering for years afterwards, but it is equally true that fraud victims suffer mentally and physically for years if not for life as a result of behaviour which has been discussed on this forum, and often proof is readily available.

Its only because the lender has not signed the loan agreement that they can get away with it. If the judge had forced them to sign the agreement any time after March 2008 then the loan would have been regulated and they would only be entitled to 30k (Provided there approved to do regulated business which there not). So you can understand why the SFO need to be involved.
 
Their are huge evidence of Criminal Fraud suronding the loans & mortages with undeclared commissions breches of the law of property act during repossessions vicktims need to evidence fraud & bombard the relevant Police forces with this evidence of fraud & if they refuse to investigate go to your M P & if he fails to help go farther up the food chain right up to the Prime Minster all this is done to protect the Banks which have operated like Ponzi schemes since deregulation

Were you told they were not regulated before you took out the loan, if not isn't that a form of misrepresentation. Though i suppose its a bit late to raise that now.

Loan was taken out in Nov 2007 which is the transition period for CCA 2006 so the removal of the 25k regulated cap only came in in Mar 2008. Therefore they where entitled to do an unregulated loan at the time if they had signed it in Nov 2007. As the contract only comes into effect when signed by both parties then any signature after Mar 2008 would create a regulated contract for which they would be in breach of financial regulation.

So,at the time ,the Lloyds takeover of HBOS was in the public interest,Yet now,the government does not seem to think that it is in the public interest,or more specifically the Lloyds shareholders interest that a court considers this to be the case.
Rather late in the day to be trying to cover up the stupidity of Gordon Brown and his vile Business Minister.

Let's not forget in the run up to this the role of James Crosby, CEO of H.B.O.S. referred to as "Brown's Banker" in the Press and a board member of the F.S.A. to boot. The F.S.A. took no action when concerns were raised with them about H.B.O.S. in 2004/2005 whilst he was in the F.S.A. role. It makes you wonder why matters panned out as they did and the Humphreys are now sensitive about this matter!

Good luck,just hope it ends up with Zephyr,the Regional Organised Crime Unit,and possibly you and your MP might request this.
By putting it out to this unit might well be enough to quell the dissatisfaction with A and S,their PCCs office and its Chief Executive John Smith,and a perceived undisclosed conflict of interest.
Seems Smiffy has been getting a bit involved with complaints to the PCC and the IPCC ,trouble is the complaints involved Phillips and his crooked cronies and their solicitors,Burges Salmon.
Well,Smiffy retired from BS in 2009,to take a much ,much lesser paid job obviously to fulfil his desire for public service,put a bit back perhaps.Seems not, No,Smiffy it appears,was given a big fat 8 year annuity on his retirement,which shows on his declaration of interests,eventually.
So good luck @Dog catcher , I think you might be in an interesting position. Certainly one of Phillips's cronies,with a certain knowledge of Crown Estates business, an intimate knowledge of the Toad and a former partner of Smiffy should be where they might look.....................if they're smart enough.

Well m'lud it wasn't just me ,everybody was at it.Seems they were too,no wonder Lloyds are so desperate to keep the lid on this.Perhaps the time has come for Government to step in ,sort it out once and for all,instead of letting it fester,.Otherwise it'll just end up as one massive gravy train for the legal profession at the expense of the shareholders.
