We have to get out

Sometime ago I said here that me and my. brother had notice to quit from the landlord after our neighbour reported us to the landlord for being under stocked and not keeping fences in order and... last week the case went to court and we now have 42 days to get out... something that will be very difficult to do... there was a lady present from housing charity and lawyer representing landlord present at hearing and afterwards she told me that me and my brother can be forcibly removed and just turned out onto the road by bailiffs..
Anyone reading this should understand that 'bad farming' or non-payment of rent or landlord requiring farm for redevelopment might allow landlord to evict the tenant but a counter notice should be served by the tenant and immediate professional advice taken - first instance go to the Tenant Farmer's Association (the lndlord may be a member of the NFU!). The case should be decided by the first tier land and property tribunal but advice is essential
and terms of the existing tenancy agreement will be crucial.

Thanks for this but have we left it too late to serve counter notice??
 
I am not sure if I mentioned this but when we had notice to get out we were also presented with a bill of just a few pounds under £50,000 for so called repairs.... but when I mentioned this at the court the council lawyer knew nothing about this and to cut a long story short now we don't have to pay it!!!

Did you find out what happened there to the change of minds?

Yes l asked because the council never back down and I was told by a spokesman that we would have great difficulty in paying so the council dropped it which is very strange to say the least
But did you find out if procedures, notices, actions served on you were correctly done as they never usually like to be seen to lose or anything ?
What did/does your legal persons say?
 
What I am thinking of doing is in a couple of weeks going to the farming press at the Royal Welsh show and ask can they do an article on it but I know that every thing must be at least 100 per cent correct beforehand

Unfortunately this seems a case of not thinking too much-ignoring or paining not knowing the implications after being severed a notice to quit , I’m saying this in a sympathetic tone

We have had something similar and if we hadn’t mentioned it to the right person in time we would have been hooked out , those reading this thread , if on an aha tenancy and you do receive said notice to quit you MUST counter this notice STRAIGHT away.

As mentioned in the thread there are many ways and means to counter the notice , just ask someone.

As it seems @startinghandle that this is via a council farm notice to quit as we were i dare say there is more to it , they have done nothing illegal by serving this notice however underhand it might be BUT being a council it won’t look good if it truly is seen as being underhand if you have done nothing against the wording of your tenancy , you do need serious help ASAP , any council won’t want bad publicity as most office type are jobs worth ending up with a nice pension , get your finger out , find someone who can sort this out.

If they served notice on yourselves for delapidations and now accept that you don't have to pay they have surely contradicted themselves and more or less admitted there were none to start with ,get yourself help by a professional, goodluck
 
You must seek some advice & quick. I'm sure the council has duty of care to rehome you if you have nowhere to go.
Let that be a lesson to us tenants: for goodness sake join the NFU or & TFA just for support.
I guess you don't want the hassle although many of us reading this would certainly have taken a different view and attitude to this injustice.
However, you may wish to contact the Rural Stress Network, RABI for support.
There is always somebody(sometimes another farmer) who'll stab you in the back and curry flavour with a landlord. These people are lowlifes, vermin and deserve a come-uppance that was metered out to those collaborators with the Nazis at the end of WW2. Good luck and better fortune in what you do in the future.

Sorry is this sounds harsh, but I don't think that will help. There will be SO many other farming related stories that week; Farming and Brexit, Senior Tory visits show, new machine wins prize, pretty girl rides horse, young farmers get drunk etc, etc that a "farmer evicted by Council" story won't even be on the radar of the majority of news outlets.
