Where do you draw the line?

Afternoon happy forum goers.
I’ve an issue with a fitter I’ve had do repairs on a machine I’ve been chasing since October, made it very clear it needed sorting, after removing the brake valve and blocking off the breather on the transmission I’ve had no end of issues with the tractor. Such as oil firing out the dipstick, out through the top cross shaft on the linkarms out the bell housing and now the clutch is very sharp - as it’s pressurised from a tipping trailer when I’ve seen the dipstick become a jet line. He had originally said he’d sorted and ordered a new part for the machine after realising what had happened. But this took me to confront this owner to even get an answer. To then wait weeks and weeks for the store man to tel me who it had come off, so I decided to ring this supplier who said he hasn’t received any order off the firm.

very clearly have put in a letter that I would be looking at legal action against them. And that any outstanding money is parked until it’s sorted because what’s the incentive for you to sort it if I’ve paid you?.
Got a reply off them when I had to ring them that they would “hit” the machine this week. Strangely enough the weeks come and gone and we’ve hay to be getting on with.

do you name and shame this Company?

As they really don’t seem to care and I’ve been very reasonable over the matter but he’s taking the mick, and damages to the machine are a direct consequence of this. As it was fine prior to this hydraulically ( new pump fitted) which led to noise and vibration then led to pipes and valves being removed and plugs being put where they shouldn’t, we need the brake valve for the machine as towing is dicey on busy roads and I don’t want to rape the brakes on the tractor for the shear hell of it / legally.

I would turn up in their yard for a free loan tractor for starters. I would then instruct them that they have to repair yours and pay another fitter (chosen by you from where ever you feel like) to work with their people to verify their work and essentially ‘pass it off’.

Once repaired the loan tractor goes back and you never deal with them again.

Are they main dealers for the brand?

We once had a serious problem with an engine rebuild, in the middle of harvest, that went on for weeks.
No joy with the dealer, so wrote to the chairman of the board (the very top man) of the tractor manufacturer.
The day after he got the letter (by recorded delivery) everybody at the dealership was suddenly running round like their @rses were on fire.

Legend has it that a dodgy JCB got sorted post haste, after it was parked on Sir Anthony Bamford’s front lawn.:D I guess you’d need to live very close to the boss man to be able to do that though.

Wasn't ours and Henry Ford was long gone before our problem. The head honcho at Basildon soon got things moving though

No sadly it isn’t a main dealers it’s a large “Shropshire” repair firm the tractor is abit older so main dealers aren’t interested but we’ve paid for a full engine rebuild clutch head and cylinder work (5ks + worth of work ) I feel very annoyed and I said that why would I haven’t spent that when it was to go towards a newer machine?

They keep blaming not enough fitters / corona virus etc but even the staff said this is a very regular occurrence with customers on the war path regularly. And I’m not wanting to drive it up there with the problems as it’s 40ish mins and we don’t have access to a low loader.

the company’s main director still on companies house has taken a back seat but I’m debating just sending a letter to their Home address as a two page letter detailing every phone call and conversation and mess has not sorted the issue to the two other company directors
