Working your notice legalities

other half works for a multi national , de facto head of UK division finance dept , her boss is an absolute arse she's had enough . Her contract says she has to work 3 months notice, is this enforceable ? Can she just walk in tomorrow and resign / quit.?
What's the legal situation ?
What's the best way to approach leaving ?

Confused, you state that your other half has a high profile job with a multinational company, then say they have had enough of their boss and are looking to walk out without honouring their binding commitment to give three months notice. If they really are is such a position walking out would be career suicide, also if they are in such a position they should know full well what the situation is without seeking help on here.

She can walk in and quit but maybe asked to work some or all of the 3 months. It really depends and also how much of that 3 months pay she wants to get. If she wants to get a reasonable reference then i would try and get to a number that both sides found ok, they would probably pay out the full 3 months then.

3 months is to protect both parties so if they had wanted to get rid of your other half at any point she would get the 3 months salary plus redundancy

In terms of legality if it was signed by both parties then its binding.

The last time I left a job with 3 months notice I ended up working 5 weeks, taking a couple of weeks holiday but it was all done on an amicable basis and I got paid for the full notice period.

I would suspect she would be put on gardening leave for the three months if she elects to resign. I would also expect the human resources department to have a chat including among other things, why quit?
If I were being flippant wait till spring and you will have a lovely garden come summer.

This would be my bet too - large multi-nationals don't want disgruntled employees working their notice, especially if they have access to vital systems.

@SIABOD50 She is wound up, she needs to calm down and have that conversation with her boss about how he is going to let her have garden leave for 3 months and give her a reference that is pre agreed, lodged with HR and all her reference requests are sent to HR.

No @rse is worth wrecking a career for. She needs that conversation.

As usual, some very sound advice above, and some arrogant bxxxsxxit aswell.

If your wife is so distressed by her boss, and wants to terminate her employment immediately, then she should not need to carry on in that environment.

However, looking forward, a reference maybe required for future employment, so she needs to speak to her Boss's boss, or the HR department.

She may well have to work out her 3 months notice, however in another department maybe.

We don't know the reasons for her distress (and we don't want to) however, she should not suffer in silence.

If she walked it is highly unlikely that the multi-national would engage over breach of contract as it would be very poor publicity. The days of a personal reference which would be supposedly non-existent as a result of walking is also now a myth as multi-nationals will have a standard reference form which will non-judgmentally state the period of service etc, so if she just left it would not affect her reference one jot. Again this is due to potential for reputational harm.
I agree that she should take this up with HR as a grievance against her boss, it could well be that she is more valuable to them than he is.(assuming the a*se is a he!).

Her boss is the UK MD who is also the cousin of the group chairman and as family he feels invincible.(both are not English ,foreign owned )
Staff in the past have complained to head office but to no avail.
She is fully aware of her contractual obligations , but the views of others from outside often bring to mind things you didn't think of .
A conversation with him is difficult as he is unpredictable ,devious and a superb manipulater.
