So if one breaks the law, what are the penalties? We reminded you that the sale and/or transfer of farm saved seed is against the law.
There are no sanctions that allow for the movement of farm saved seed and doing so remains illegal.
To trade in Certified Seed of protected varieties, you must hold a BSPB Sub-Licence in addition to being registered with the Ministry (APHA/SASA) – please contact BSPB for details.
Certified Seed can be sown and subsequently re-sown, as Farm Saved Seed, on the same holding. Certified Seed cannot be sold, traded, bartered or re-packaged without the required licences.
Any queries, please call us on 01353 653209.
Though I don't expect a reply. You are have made if rather clear your unwilling to engage here where replies are public record. I find it rather shameful given it is the royalties paid but us growers that fund your existence. If you wish to participate in the forum you should play an advisory role not just one in which your contribution is only to issue legal threats. I really have no wish to discuss these issues with you in private phone conversations. I am talking purely hypotheticals, I have no plans to breach the legislation personally, my spring drillings this year, if it ever dries, are all SFI and all the seed mixes have already been purchased through the legal certified channels. Now that being said I can absolutely see why people will be contemplating sticking up 2 fingers because bad laws are treated with the contempt they deserve and the legislation has really fallen behind todays realities. You should have a role in ensuring the legislation is fit for purpose and clearly it no longer is.
