Network rail access

recently they've been doing a job up here involving replacing a couple of culverts under the line, the amount of new materials that was left when finished ran into 10s of thousands, the project manager should be sacked for waste like that, twin wall piping, timber, dumpy bags of sand and 100s of tons of sub base, even a couple of new ladders that they were using to climb up the bank, but i know the person who ended up getting it all as would of cost more to take it away :X3:

Come 3pm on Friday, they couldn't be arsed carrying the tools back to the van so they told the 360 driver to take a bucket out the embankment buried a van load of tools and clocked off. Turned up the following Monday at 11am having spent the morning buying all new tools and putting them on the company account.
 
Ah yes, but Network Rail, [previously known as effing Railtrack] have a buying head and a selling head & ne'er the twain shall meet. I could rant forever about my professional dealings with Railtrack, but I don't want to reduce you all to tears.

Sounds like the lads had the tools sold there’s a reason a disproportionate amount of railways men are scouse
 
This bit isn’t strictly true. If there is a danger to life then they can very quickly get powers of access via a court, if they do go to court you’ll get peanuts and it’ll be on their terms. Obviously you can, if you act swiftly enough in this instance, save them the hassle and negotiate an access fee, if you’re cheaper than the legal fees they’ll take that route. Personally I prefer to do it this way if possible, I dictate the terms, get their legal department to draw up an access agreement and I check carefully that they’ve put all my terms in the agreement before I sign it. I know plenty of farmers who have hassle with Network Rail but I’ve had quite a bit to do with them, haven’t stood any nonsense and clamped down on anything I wasn’t happy about but I’d say that generally my working relationship with them has been very good.

We’ve just be approach by network rail who want access to mend a tunnel which could take upto 4 weeks? What is the going rate for access compensation?
Last job here access with compound and tipping area was capped at £750 per week plus £1050 disturbance payment (1800 per week) then overrun off 3600 as they always overrun but get a decent land agent on it as network rail or the contractor will try and stitch you up
Also make sure the license is from network rail

Gates on either side are 15ft. Combine is 14ft, 6”
Any point asking them about possibility of fitting wider gates?

You'll have no chance of that. We've a crossing with 12ft gates and tried to get them widened them but got told there's no chance at all. They are trying to close as many gated crossings as they can for "safety reasons "

Exactly this. A good few years ago I used to sit on the Agricultural Safety Board and we often had representatives from Network Rail there. Unmanned level crossings have a near miss nearly every day of the year, they’re trying to close them as fast as possible.

Thanks so you wouldn’t negotiate with them directly yourself? Can you get a land agent via the CLA? Do they take a % of the payment?

When ever we tried doing it our self they’ve stitched us up in one way or another plus with out a network rail license they could hold you responsible if anything goes wrong with there job

Had network rail lad here earlier (spoke to missus) about wanting to access railway from our land to trim back trees and vegetation. Few vans and a mini digger for a week apparently.

Anyone been in this situation? Asked what the going rate is for access he seemed quite woolly and said that was a different department.

Any thoughts?

Get an agent .Evenwith an agent it took them18months to pay for a strip of land by the the railway side they purchased and developed from me for £8500.I made the mistake of assuming I would be paid within a few weeks of completion and foolishly spent some of this money before being paid!Be aware these guys are out to cut you down and an agent is an absolute must.£2000 a week with penalties for late payment i suggest

Depends how quick they want access, we had a request last summer that they wanted quickly, they offered a reasonable figure which I doubled they suggested ten percent off that figure which I was more than happy with, as usual they over ran and are coming back this summer to finish it once river levels are down. They are far better than water providers who are barstewards

Lord help you if the Water company etc are using Dalcour Maclaren as their Agents.

I was involved with an access for a main sewer and DM were involved, I told them what I wanted, and their response was that they would only deal with my Agent. I told them my Terms, and 2 years later, they have still not turned up....
