Who was there first? The dog or the complaining neighbour? If you move next door to someone who has a barking dog (or most other nuisances) you have to accept what you find. Learn what the bark means. Dogs have different barks for different things. I can tell from the tone of the bark whether my dogs are barking at an unknown visitor, the postie, a fox, or just bordom or play. If you have to complain, complain to the dog warden or environmental health who will deal with the matter without disclosing your name as the complainer. There are lots of reasons why a dog will bark. Could be cruelty or neglect.

I agree with you but sadly you cannot assume who was there first will win as regards enforcement where someone can prove a nuisance
