i have a farm track which I gave permission to the council to use as a permissive path about 30 years ago when the community forest was trying to improve access. It linked two linear paths to create a circular route. I have now sold the buildings to which the track goes and the builder has blocked the access for security. The council do not have any record of allowing permissive access. I did a declaration in 2013 but the ramblers are claiming they had used it unchallenged for 20 years before that. Supposedly 50 people have put in a claim but we are not allowed to see their identity! So they could have moved in last week. It appears the council rights of way officer is judge and jury. WTF
