I have a friend, she married a farmer from the states, a footpath is at the risk of the user and tresspassers can be, and often are, dispatched (careful with my words, certainly not making a threat) lawfully for walking on private property without a good reason.
Simply put footpaths should exist as they are, and be closed as soon as evidence for miss use is presented to the LA. TO repopen should require objections and reasons why, and if the miss use reoccurs an asbo like order against "Persons unknown" or all users of the path, and permanent closure follows.
I have a camera watching this path as its such an issue. 400-600 users a day at weekends (August bank hol last year over 900) and 200 a day in the week... even %1 of public causing issue would cause 30 acres to be un usable at that level.... I can safely say that 30% are dog walkers and 80% of those are totally irresponsible and criminal in conduct.
Thats 90+ dog sh1!s a day or walking through sheep fields...... every weekend. GO figure. I fenced it off last year and again this year. A new fence and it looks like a 40y old one from all the cut wire.
