Ripped off by HRN Tractors / Agritrac Exports Ltd (Stuart Barclay) - Aberdeenshire

I'm about to commence a county court claim against this outfit, who sold me a tractor which was significantly mis-described. Does anyone else have any similar experiences with them?

Long story short, I enquired about a 2013 MF5410 early November 2023. I decided against progressing the enquiry (mainly because they had failed to mention in the advert that it had, had the clocks replaced!) but then a month or so later they call me out of the blue and ask me if I would be interested at a reduced price. I make an offer (£24.5k as opposed to the advertised £27.5k) on the specific basis the machine is supplied in full working order, i.e. I'm not expecting a shiny new tractor but everything must work as intended.

They agree and deliver it to me with faults including -

1) significant water ingress from the cab roof hatch due to badly corroded hinges - large amounts of water coming in whenever it rained.
2) seat collapsing (wiring fault)
3) heater controls inoperable
4) front loader grab inoperable (wiring fault and solenoid fault)
5) washer motor inoperable
6) 5 light/indicator bulbs out (yes 5!)
7) low engine oil
8) no door keys for the cab
9) hitch mirror cracked
10) radio inoperable - the water ingress had killed it

All issues reported to HRN immediately with a video showing the faults. No apology from HRN who have since shown absolutely no interest in rectifying any of the issues and claim I should have expected issues with it because they sold it to me at a price lower than initially advertised, which is complete BS as my offer was specifically on the basis it was in full working order and they accepted the offer on that basis.

It's a pain taking them to court but I think it's the right thing to do, particularly because of their fabricated claim to have reduced the price to reflect faults.

Anyone else had similar issues with this company?
Why didn’t you return it?

I know someone years ago got demo or hire I can't remember which, of a tractor from HRN, before it went back the said machine had everything was removable swapped with their own tractor. Bulbs, fuses, tyre valve caps. Ariel. The fkahing beacon It was said even the air I the tyres were swapped and if they could've have swapped paint they would have.! It was like a scene from the A Team when they used to strip down vehicles!!!

I wouldn't consider working lights to be a specifically high standard.
Fair enough on a 40 yr old David Brown but it's not an unreasonable ask on a 10 year old tractor.
I dont want to work in the dark.
I have looked at agritrac tractors online before and got the feeling there for export, as in send them somewhere else to get bodged up. I wouldn't expect too much from them. But I didn't buy it.

The clue is in the name Agritrac Exports!
They were a stand alone depot near Stirling but seem to be listed as part of HRN on the website now.

And there I was thinking Yorkshiremen were tight......it`s always been a bit nip and tuck with the Scots... looks a bit like they`re edging in to the lead though..;)

The distance selling act should allow you to insist on returning it and your money back without even having to state or argue faults. 14 days to start the process provided you have not visited the seller in person at any stage.

It`s just a bl**dy minefield... Always surprised what some franchised dealers try to sell on with minimal checking over, and this is not always reflected in their pricing.....

Only if it’s unreasonable to expect the buyer to travel and view. In this case it wasn’t.
You can’t just reject something because you couldn’t be bothered to view.

Please correct me if I’m wrong

Man rings up for tractor, gets told clocks been changed and declined it.
Then a week later buys tractor knowing clocks changed but for less money.

Then tries to take company to court because clocks been changed.
He never mentioned the clock in his list of faults

My take on it...

Hmm, they should've mentioned it but doesn't affect working order.

2) seat collapsing (wiring fault)
Not sure what he means tbh. Collapsing implies airbag. If it was wiring fault it wouldn't pump up in the first place.

3) heater controls inoperable
Again they should've mentioned it but the tractors still working

4) front loader grab inoperable (wiring fault and solenoid fault)
He can't use the third service, tractor's not in working order.

5) washer motor inoperable
As 1 and 3

6) 5 light/indicator bulbs out (yes 5!)
As 1 and 3, but ffs if they can't put a few bulbs in...

7) low engine oil
As above

8) no door keys for the cab
Probably didn't come to them with door keys, no big deal.

9) hitch mirror cracked
Nit picking, but annoying on top of everything else.

10) radio inoperable - the water ingress had killed it
As previously, they should've mentioned it but the tractors still working.

I'd have moaned about it a bit and then said, I can't use it without the third service, send me a solenoid and we'll call it quits.
Then I'd have made a mental note to avoid them in future.

It could all be put right for less than the discount on the original price, if he can do it himself. But they should have been honest then he had the choice of whether he wanted to go to that trouble.
