Ripped off by HRN Tractors / Agritrac Exports Ltd (Stuart Barclay) - Aberdeenshire

I'm about to commence a county court claim against this outfit, who sold me a tractor which was significantly mis-described. Does anyone else have any similar experiences with them?

Long story short, I enquired about a 2013 MF5410 early November 2023. I decided against progressing the enquiry (mainly because they had failed to mention in the advert that it had, had the clocks replaced!) but then a month or so later they call me out of the blue and ask me if I would be interested at a reduced price. I make an offer (£24.5k as opposed to the advertised £27.5k) on the specific basis the machine is supplied in full working order, i.e. I'm not expecting a shiny new tractor but everything must work as intended.

They agree and deliver it to me with faults including -

1) significant water ingress from the cab roof hatch due to badly corroded hinges - large amounts of water coming in whenever it rained.
2) seat collapsing (wiring fault)
3) heater controls inoperable
4) front loader grab inoperable (wiring fault and solenoid fault)
5) washer motor inoperable
6) 5 light/indicator bulbs out (yes 5!)
7) low engine oil
8) no door keys for the cab
9) hitch mirror cracked
10) radio inoperable - the water ingress had killed it

All issues reported to HRN immediately with a video showing the faults. No apology from HRN who have since shown absolutely no interest in rectifying any of the issues and claim I should have expected issues with it because they sold it to me at a price lower than initially advertised, which is complete BS as my offer was specifically on the basis it was in full working order and they accepted the offer on that basis.

It's a pain taking them to court but I think it's the right thing to do, particularly because of their fabricated claim to have reduced the price to reflect faults.

Anyone else had similar issues with this company?

I take it you didn't view, I got bitten once but at least the dealer from Ireland refunded in full. It's been a long wet winter and the tractor you've bought has probably been out in it. Get some legal advice, they won't want it back, best you could get is a bit more knocked off for roof repairs. Good luck

I wasn't looking for a mint condition machine - but the faults were very obvious and should have been disclosed.

Phoned them while it was still on the wagon and they asked if he would keep it if they gave him about three grand back,which he agreed to. About ten years ago and the cheque hasn't arrived yet

Can you let me know when he gets it, I think my premium bond jackpot got lost in the same post!

We've bought a few things off them tractors, ploughs etc.

No issues, always viewed first. With implements they've put them on tractors so we can see them working.

You should have viewed it first. Just bought a year old tractor with 1500 hours and spent a couple days travelling to view it.

Sorry for your troubles but you should ALWAYS go and see machinery before buying, especially tractors. (although you may have come to that conclusion already) They perhaps have pushed the envelope too far but there is always a bit of variation in what one person would see as GWO and acceptable compared to another. Yes they should have been more honest about what didn't work but distance is no reason to not go and see a machine first, and if it is accept you have to buy closer to home

I bought a tractor in England, didn’t view because of covid, reputable dealer tractor described as mint came it was OK brakes went next day and fuel problem shortly after, was basically off farm condition, put it down to a bad experience and all fixed and lovely tractor now.

If it was a bigger price tractor I’d only buy local so I could view it though

It's a 10 year old tractor and the faults listed won't take alot of sorting out/tidying up.
If you don't go and see it you have to expect some faults.
Take it on the chin and move on.

In all fairness,the machine has been faultless for him but it goes to show that if you haven't got something in writing, you're knackered.

Appreciate that in an ideal world I would have viewed it first but as professional machinery dealers it should have been very obvious to them that it was a long way from being in 'full working order'!

The bit that is annoying me is their claim to have reduced the price to reflect disclosed faults - which is total fabrication.

Perhaps I got unlucky with this particular machine but then again the customer service post sale has been pretty terrible!

Only hearing one side of the story but, if true, the man has stated the terms on which he would accept and the dealer agreed - I think the dealer should stand by the faults or send a cheque to cover repairing it locally

I didn't want perfect and I didn't want new. I wanted used and in full working order. If they didn't want to sell it to me on those terms then they shouldn't have agreed to them!

I'm happy to see what a county court judge thinks of it!

We bought a 7930 off them a while back there was a fault with it they supplied the part and paid for the local dealer to sort it out can't say there were any issues with them .

As above even if you were abroad there's no reason to not travel to go see a machine or get someone closer to independently veiw it furst
