BPS Misreporting Penalties

Hello there,

The RPA sent me a remote sensing report that spotted I had mistakenly claimed a couple of hedges in my EFA that I shouldn't have. Genuine error.

Does anyone know what sort of penalty I can expect from this?

I have 20% more EFA hectares than I actually need, so the couple of hundred meters that I got wrong could have been not claimed. Not sure if that makes a difference.

I'd say it would be up to the mood of the inspector, someone I know had a small problem regarding ploughing a bit more than he should of which the inspector offset against good hedges which could of been claimed but weren't.
Would pay to gently point out the fact you got 20% more than needed.

We had a report with no issues and they still fined me 2%. The thing is they know you won't complain as it holds up the whole claim.

Similar problem for me. Remote sensing inspection showed up errors with hedge measurements. I've got about 20% spare as well. Wrote back to th m saying I'm fine with your new measurements but wouldn't be happy about any fines as I was using the measurements the RPA gave me 3 years ago. As far as I'm concerned any errors in my claim are a result of their mistakes.

I suspect the inspector will be busy fining me 100% of my claim

I'm contesting the remote sensing and fully expecting to have to wait 3 months for my money and also have a full blown inspection.

I am still awaiting my 2019 BPS as they claimed my wheat fields were woodland.They have admitted
their mistake in writing but are still refusing to pay me as the system now thinks I am making a fraudulent claim.Couldn,t make it up.
