Hello, I bought a 40 acre field a few years ago with a right to connect to a shared borehole. I am wanting to connect to the borehole and run a pipe into my field and fill a tank so I can do some spraying. It is a real pain to go back to the main farm to fill up. The deeds say that when it comes to maintenance I should pay "a fair proportion calculated in accordance with user". The thing is I will only be using maybe 20 cubic metres a year and at the moment the borehole currently delivers 2000 cubic metres a year in total to the 3 other users. I am having difficulty with the other users about what fair proportion means. How do you understand it?

Yes I am going to put a meter in but if I do use 20 cubic metres and they use 2000 cubic metres a year do I pay 1% of the total maintenance or 25%? How do you understand the term "fair proportion"?

Are you sure it doesn't say 'Fair proportion in accordance with usage', not user?

Well I don't know what that sentence means. Ask a solicitor, maybe it has some legal meaning that ordinary mortals aren't privy to.
