Filling in a dry watercourse.

Lets pretend that a watercourse only caused by land drainage water and therefore drying up as the weather dictates has been put under ground into the largest flexicoil available , lets say 5 years ago.
And lets pretend that the resulting unused gutter/watercourse has been filled over with spare sub and topsoil and that a complaint to the local council has been made.
Could the landowner be in trouble?

Around here its not a council issue, just have to ask permission from the local drainage board, or retrospectively in this case ;)

Biggest issue would be where you have received the soil from. Could be classified as unregistered tip and enforcement action to remove spoil. If from your own site works ie new build excavation then I doubt it would be a problem.

sounds like we need not pretend anymore , i can't see an issue as it sounds like the water would have made its way to where you have piped it anyway as long as you have done no tipping
