I sold some equipment to a company who have become insolvent before they settled my invoice, they have sold the equipment on but I don’t think it’s been paid for, do I have any claim on the equipment?

Thanks in advance for any help

Find out who it’s been sold onto and tell them who sold it to them didn’t have title to do so and go recover asap or ask for payment direct

Did you put on the bottom of your Sales invoice

Title doesn’t pass to buyer, until the goods are paid for in full

You will need to contact the receiver who is liquidating the company show them your invoice and what they owe they then should settle a percentage of what they owe you (hopefully)

Was it small enough that they might have drawn the cash, off the books?
If it says on your invoice "Goods remain, etc" you may have some hope of repossession only if item is clearly identifiable as yours beyond any doubt.
Don't think people get anywhere with bulk grain, for example.

I think if you can salvage it without any damage to the second purchaser then it will be up to the liquidator to take action against you and that is extremely unlikely.

Go fetch it back first job in the morning if it’s possible. Be the best mornings work you have ever done. If the shitee hits the fan at least you are in the driving seat.

+1, if you know where it is, just go get it. Maybe take some "friends" with you. Posession is 9/10ths of the law, I'm sure you can make up the other 1/10th by showing any relevant authorities that it's still yours.

Legally speaking, you'll be entitled to something. In the real world, you'll get 5/8ths of jack sh*t and the only people that will get anything are the lawyers and the insolvency practitioners.

Re. being in the drivers seat, this comes to mind:

They can't get you out of the car.
