Lake insurance

A fishing lodge bordering our land has been offered for sale to us.
We don't really want it but we have right of access over it's banking and would like to keep it nice as it is as it is in direct line of site from the house. Another local lodge was purcased a few years ago near us and drained which now looks dreadful.
I approached NFU for an insurance quote but they refused to insure it as it is next to a road and public footpath and is unfenced.
Would anyone be able to suggest a possible insurer and also point me in the direction of anything I should be aware of before we buy it. Any ongoing liabilities/costs?
As far as I am aware, it doesn't fall into the reservoirs act as its capacity to hold water is just under the threshold.
I would say it's probably around 1/5 acre in size.
 
we use an agent, but i think ultimately its with Rural. in our case with a new build, i imagine that a dam wall burst would be linked back to the construction engineers and there professional indemnity. a dam wall burst was not mentioned by the insurers.
 
my insurance company only requested deep water signs and a life ring be installed for my new lake.

I was thinking about this just yesterday.

I cycled past a set of three reservoirs, with a sign saying "Danger Deep Water". There are no fences at all.

As I understood it, a landowner couldn't admit a danger without provisions in place to mitigate risk e.g. bull in field, mud on road etc.

May be the sign is well out of date and should now read "Warning Deep Water"? :scratchhead:

This one has a very wide banking of probably 12ft across on the top and at least double that on the bottom but it's effectively a dam and there's a few houses in direct line of it if it went.
It looks perfectly safe enough but I'd want to make sure all bases were covered with insurance before we commited to buying it.

It is unfenced and there is a public footpath along the banking. It has been like this as long as I've known and it doesn't have any warning signs or water aids. I need to speak to someone in the know.

This is dangerous rubbish. I'm member of institute of occupational health and safety, have some qualifications in that area. I have no idea where the rumour came from. You can't ignore a risk and not sign post it, the mitigation might actually be the sign. It all depends on your risk assessment and the paperwork to show you've considered the hazard and you have taken an action to mitigate the risk.

You don't admit liability by sign posting it but you might have a legal duty to fix it, for example mud on the road, you shouldn't be putting mud on the road and if you are you should be clearing it off, but the sign post is not where the liability comes from its your inaction in the first place.
