Just had a letter in detailing new cross compliance measures from 2025.
"New drainage and maintenance of existing drainage systems that causes further drying out of a peatland or wetlands"
We have a boundary ditch with a peat wetland area owned by a Scottish Government quango. Around 100 acres of our agricultural land drains into this ditch. Legally I believe I'm allowed to maintain it to it's current standard/depth periodically. My title deeds also state it is a shared ditch although it is on their side of the fence, with both parties responsible for carrying out routine maintenance with a 50/50 split of costs.
Now this new legislation I believe means I cannot maintain this ditch as it will be seen to aid in the drying out of the peatland?
Genuinely fed up with all this environmental stuff now, if this is the case I may as well give up.
