Prior Notification and Covid

Hi had a application for a new building under prior notification validated on the 3rd December. On the 5th Jan the case officer emailed asking for a weeks extension and that the application is on hold. Can the council claim that due to Covid they can put the application on hold.

No I don't believe so. Is that the reason they have given? They can't put a Prior Notification application on hold. You can agree to an extension but normally this is only in the case that further information is required.

Not not the reason just says that they have a backlog of applications.
What options would the LA have if i polity told them that the date has passed and that work has started.

Be careful with that approach it’s not as clear cut as it may sound if they considered you application was invalid or you did not satisfy the requirements for pd they do not have to let you know , I would work with them if you are getting positive vibes after all I don’t think they would be asking for more time if they intended turning you down we have agreed to this numerous times and all granted , unless it was a part q where I would insist they stick to time frame , And remember you may need to work with them in future Licking often works better than kicking

When I pointed out my application had gone over the 28 days and I could claim it had passed they replied they could simply claim it wasn't a typical ag building and therefore completely reject it as an invalid application.
The fact that you'd struggle to find any farmyard within 10 miles that didn't have an almost identical building was irrelevant.
Took 8 weeks instead of 4 but got what I wanted. Worth the wait but didn't feel like it at the time.
 
We recently had the same on a job with a mine shaft entry close to the building... pre comensement condition, need to prove the location and structural integrity of the concrete cap on shaft entry.

British coal mining authority... all on furlough

Council... reduced staff numbers so "unable to make comment at this time"

Covid is a great excuse so you just have to be patient and bite your tongue

covid has a silver lining, I don’t think the listed building man came out before commenting on one here - happy days
