Can someone remind me what the name of the act or law is which allows you to reject a brought item for a full refund due to faults or not being fit for purpose?
Asking for a friend as a car they collected yesterday with a brand new mot has lost a wheel today due to a rusted suspension arm breaking

Was paid all together by debit card, mot appears genuine as it shows on the mot check
Wouldn't be so bad but the mot dated 7th January says this under advisories
  • Nearside Rear Lower Suspension arm corroded but not seriously weakened (5.3.3 (b) (i))
  • Offside Rear Lower Suspension arm corroded but not seriously weakened (

The car was recovered to the selling garage so I can't even look myself, but considering how it was advised and has immediately failed I have advised her not to have the car back even if repaired as I have no trust that anything else is going to fall off

Trouble is ,paying by debit card ,,there isnt much chance of getting the money back and if the seller fixes it ,they are going to want payment for the repairs ,,,

There’s always a local company in most towns that will ‘get you an mot’ I’m afraid. Obviously buying a used car you need to thoroughly check it. She can’t of done that so the seller will argue she had checked it and accepted it and it will of been sold as seen. Can’t see much come back I’m afraid other than shaming them on the local towns fb page.

If they know what is good for them they will give her her money back.
There is a mechanism to allow you to report mot issues, DVSA form VT17, and they will follow up with the issuing station.
Then go to trading standards as well.

The garage in question isn't a back alley second hand car dealer, they are mg, Skoda and Chevrolet dealers.
I wanted to look at the car on Saturday for her but was busy with work and was going to look over it this weekend before she did many miles with it

I don't believe that "sold as seen" is an option in a deal to sell a vehicle to a private seller.
