I believe this has been previously mentioned in other threads, but has anyone actually had anything in writing from HMRC or similar to clarify the position. We are looking at NUM3 Legume Fallow which appears to be eligible for APR. However, with 2 parents / farm partners in their mid 80s and not the best of health ‘should be ok’ isn’t good enough.

It is under the sustainable ‘farming’ incentive after all, so I would hope it does qualify, although I understand your need for a definitive answer.

There is nothing that worries me about the wording of the HMRC guidance at all. Everything you have described says "active agricultural activity" to me. The SFI isn't long term at all. You will be sowing and topping it, not walking away and living off the unearned income.
