Trading standards prosecution

So after speaking with them this afternoon.
They are looking to prosecute.
Doing me for obstruction. Even though told them where they were etc.
Said they don’t fine off the sub now either. Also it more than likely could end up in court and mite get time. I was abit shocked to be frank as it is a first time offence and they know the problems we are having.
have you actually been charged pretty sure you will need a visit from local PC in meantime get yourself off to your doctor and tell them what your telling us about wife,baby and how its getting to you, and if you do get charged get a good lawyer

No not been charged yet. Spoke to lawyer today he reckons it would be ridiculous if I got time and didn’t recon it will get there
 
I can see it is very stressful I really can but I really doubt they will prosecute, to be fair im from way down south and had issues with county council and they had no money at all to take issues to court so I locally reaped the gain. But also an elderly friend missed passport applications when he lost his wife and dad in fairly quick succession , he got them all printed and received quite simply, but needed doctors documentation proving dad and wife died, sounds barbaric but guess fair, provide gp proof of wife poorly or sick and complications with child and its fair enough. Does carry weight, don't be shy, so long as a registered appointment with unwell spouse or child, or complications with child and regular appointments then im sure you will pass it off as was going to order tags but forgot, just don't admit you did forget, you were stressed or traumitised or caring for child, im guessing this will carry more weight than admitting fault!!

As @Lovegoodstock says it would be ridiculous if they prosecuted unless you had a history of none compliance. As your in Cumbria i would seek advice from the Farmer Network, Adam Day was on here I think but can't think what he called himself. Also get in touch with the NFU of your a member, they helped me when I was ill and was getting hassle from Fabbl. But most of all see your gp and explain the situation and how stressed you are, they can help and also be a back up if needed

You are certainly not going to prison for missing tags on 1 cow but expect a fine. Surprised they are not taking a percentage of SFP as that is easy to collect and costs them nothing. I presume the buyer is in trouble too.

Hope you get this sorted out ok. What a load of rubbish causing you so much stress and worry over one animal. I am really getting pee'd off with the jobsworths in this country. You try your best to produce good quality food and get these little pricks making it hard work. This is the reason I try and avoid inspectors as I feel I might lose my rag with their stupid rules and tell them where to stick their inspections.

What if she is tagged with the small metal tags? Half of the calves we buy in each year are still on them, if they have dark ears you can’t see the metal tags.

I'd suspect them saying they will prosecute is the punishment in itself that they are dishing out. After all, they are unlikely to pat an offender on the head and tell them not to worry! So, putting the frighteners on will be the major part of the punishment,

A letter from the doctor, and maybe character references from respected public figures who might help, is the way to go. They obviously can't let you off scot free so it could just be a big bollocking. Try not to worry and gather your forces to defend yourself. We all make mistakes and it wasn't as if you were trying to pass off condemned meat as healthy or do anything fraudulent.

I had a friend , who got himself into all sorts of bother, trading standards bent over backwards to help, once they new he had been diagnosed with terminal illness , still had to go to court but nothing too serious , sure it will pan out ok.

If this goes any further than a rap on the knuckles then something needs to change in this country when you see what other ppl get away with and seemingly nothing can ever be done.
A warning letter would be sufficient for a first offence I would have thought . Unless of course she’s bulled with a donkey and contains more than one species dna:banghead:

So thats alright then,as long as we have been diagnosed with a terminal illness:banghead: No farmer anywhere should have to put up with this!!
 
I have been prosecuted by CTS and they will go for the jugular, sorry to say.
They will make you sweat by taking you to court , letting you spend money on legal fees, then offer you a deal before going into court, or at least they did with me.
They have just done someone else locally as discussed on here and will seek to do so again as it justifies their existence.
Unless you can get a cast iron defence lined up I would represent myself and either take a deal or plead guilty.
Don't waste your money on the legal service, I went through the NFU and their legal firm were crap, I paid for a barrister and the whole nine yards.
CTS have loads of money and even if they hadn't they will get most of the cost from you if you lose or take a deal.
Suck it up and move on with your life.

To be honest let them huff and puff and go to court if you have to, any sane judge will not put you anywhere near a cell, let alone give you a big fine. Just go along with it and be honest all the way. We generally have a decent legal system.

They go completely over the top, I attracted their attention over an oversight that I wasn't even aware of and got told they were likely to interview me under caution with a view to prosecuting. They could never have proved I was guilty as charged and I was relaxed about it as far as you can be but it's still a weight off your mind when they drop it, although they would bring it back if I do anything else that they could jump on. But their threatening manner could cause a great deal of distress to anybody with insecurities or personal problems when in most cases it's nothing more than an unintentional error. They know that a farmer's good name is vital to him and when you see the slap on the wrist sentencing they hand out for premeditated stuff it's unbelievable.

Surely they can not prove date when picture was taken, if they receive another picture with newspaper dated when suits for your purpose, you can plead ignorance to admitting a thing, if note recorded conversation its your word against theirs, best of luck to you try not to let it get you down, where is Walter p when he could actually be of some use
