Just spoke to Nick and TRP Imports is still running. I think there maybe some confusion with TRP Scotland which was a dealer and is no longer trading.

The situation is that TRP Imports is still trading and is suppling machinery of the 3 brands it currently imports through the dealer network and this business will continue to grow. TRP (Scotland) or the retail branch at Sleaford has voluntary ceased trading. It has not "Gone Bust", the owners and directors of the business took the painful decision after 41 years of trading that in the changing face of the agri machinery business to stop by choice rather than "go bust".

So if they're still trading, does that mean I can get the money that is owed by the Sleaford depot ??

TRP Imports is a separate business. TRP which has ceased trading is in the hands of accountants, and nothing to do with the owners now.

Depends what your definition of going bust is, but I understand from an ex employee that they were called in to a meeting and told to go home, because there was no job for them - make your own definition of that, but it doesn't appear to be a controlled withdrawal from the agri machinery business to me.

Nor me. Sleaford gates were locked, nothing moving in or out, and the email we got didn't refer to 'ceased trading'.

Nothing to do with the owners now ! How can you say that ? Surely the owners are responsible for the companies debts. You can't run a company building up debts and then walk away saying its in the accountants hands and nothing to do with the owners anymore.

The owners have no control of the finances, so if anyone is looking for payment the owners hands are now tied. Would be the same if House of Fraser ceased trading or any other large business. Once the business has ceased and the accounts are called in the owners or ex owners have no control.

Actually you can. That's the principle of a limited company, it limits the liability of the shareholders to no more than the capital they have invested.

The directors may be a different story of course.

Yes I agree, that is the case if a business has gone into voluntary or compulsory liquidation / receivership - however they claim not to have done this and simply chosen to close the business. Therefore, surely the directors have a moral and legal responsibility to pay its creditors?

I guess Company Law and Morality don't always go hand in hand :-(

Looks like a Voluntary Arrangement so the appointed administrators can judge the true financial state of the Ltd Company and then try and sell as an ongoing business or just sell off all the assets and return surplus if any to creditors.

I spoke to Nick there maybe 2 weeks ago.
Just checked on Companies House website - the directors of TRP (Scotland) Ltd and TRP Imports Ltd appear to be the same people - strange that. So much for being completely separate companies with no connection. So I don't think that there is any confusion in the minds of TRP's suppliers or customers - we are just victims !
