Unpaid rent-debt recovery worth it?

So what is the tenants anger really about would you think - peed off at having the tenancy not being renewed after messing up your property?

So your place was being used as residential for his drivers et al and the other place as a business depot for courier vans?

I would love to know, but he comes across as very unstable, I have seen signs of drug use paraphernalia in the past.

He also comes across as some one who wants everything for nothing.

He's accused me of being being landlord from hell, funny enough 6 other tenants here, some who have been here for years, have zero issues and are fully supportive with current situation.

Trouble is with these characters they have got nothing to lose and you've got everything to lose and they know it and play on it 🤬

But they have their clean credit rating to lose, even if you can't force them to pay what the judge orders.

I had a similar problem last year but with all thats going on I wasn't prepared to just write off £6k in rent arrears so I had Frontline Collections recommended to me and got them on the job.

First problem was to get them out which I did via a section 21 notice then I handed it over to Frontline who did the rest. Needed a CCJ in the end but they took care of it all for me and now the debt is being paid off at £400 per month which is a good result overall and certainly better than nothing.

Suppose it depends on your principles really. For me it was about the money as they may as well have simply stolen my bank card and taken £6k out of my account

Just off the phone with the police yet again.

This morning I get an audio call on facebook messenger from the tenant.

5:30am

I was awake as in the lambing shed but did not take the call.

He then sent me a number of messages threatening me and my property. (Windows will be smashed, roof slates pulled off. There will be consequences, I will com pay you a visit and have a good old discussion, etc etc.)
He's doing non of that

Have a nightmare tenant that is 6 months behind in rent and also nt paid electric/water for same period (both are sub metered from
Mains supply I pay)

Oil tank is also nearly empty as was full when he moved in and tenancy says he has to leave it full when he leaves.

his tenancy ends at the end of this months and I served him the correct paperwork a month ago to vacate the property.

Looks like he is leaving this weekend as he’s packing up his stuff.

he owes me over £8k all in.

he also owes the council his council tax fur a year and their debt recovery agents have been on site twice looking for him.

Are debt recovery agents any good at getting anything back?

When he paid rent it came from his business account and latest set of accounts, only 4 months old, show plenty of assets and cash with a profitable company.

He’s not a nice person though. Police been out at least 2 times since last spring for domestic violence reports from his wife/partner.

He’s threatened me a number of times with setting his pit bull on me, I’m not sure if is a XL or not but it’s as mean as he is and I have to be careful to keep my dogs away from it as it goes ballistic when it sees mine.

if I meet him in his car on the local lanes he will drive at me and refuse to reverse forcing me to reverse upto 500m at times. And then screams at me as I do.

on interview before moving in he was nice as pie, references all good and sound.

in 20plyz years of tenth about 7 properties on the farm I've never had an issue before do.

Maybe I’m due my dose of crap.

with his personality I’ll prob just walk away from the debt in case he does something worse.
You say his business has assets. Sue him get judgment and if he doesn't pay bankrupt him.

Not hear anything from him since, locks are changed and have started getting the property back in hand, cleaners where in for 7 hours yesterday just getting the place staright.

Need new carpets in a couple rooms and some walls need repainting/repairing and need to repair various kitchen cabinets/doors.

Hes left a bloody great fridge freezer that I will put on facebook free to who ever wants it though it needs a bloody good clean.

Bizarrely he is still using the address for amazon deliveries, had 3 yesterday in fact. One was dropped off in my office and as I was expecting something I openned it with out look at the address, it was a load of CBD gummy "sweets"....

I've been following this thread on a similar basis with a small commercial tenant only on £350 a month rent. Tenancy is in his name, trading as XX business (i.e. John Smith, trading as John Smith Building Ltd.). His Ltd Co shows as dissolved a few months ago.

Agent who drew up the agreement now being less than helpful. They did set it up a named third party as a guarantor initially though which might be of some help.

Weighing up whether 10% or so money claim online fees is just throwing good money after bad. Never been through the process before so concerned that a claim could fall flat on it's face. Did a tenancy deposit claim a few months back and that was a waste of space as the system just seems tenant biased.

Can you proved he kept trading when he know the Ltd could not pay the rent?
Is the contact in his own name or with his Ltd?
Did he keep to the correct rules with creditor when closeing the Ltd?
(If he have kept using the unit, it should be easy.)

Eg can you make him personally liable?

Surely your agent should be doing all that for their fees. We had a flat and they sorted everything including checking on annoying tenants. I got leccy bill a year after one tenant and just passed it to the agent. Heard no more

Not sure how I would prove that.

It’s small tradesman commercial unit tenancy.

As above contract is “John Smith trading as….” Unsure if that is personal enough.
