Water pipe

Evening
We bought a farm few years ago, sold the house off, they have a private water supply in our field. Pumped up the hill to a concrete tank up the hill in an asbestos pipe and then returns down the hill again
Rented field for potatoes and and they dug it up and fixed it, it's just below the plough pan at 12 inches!!
I ripped it up with the plough the following year and fixed it at my own expense, spoke about deepening but nothing's happened, spraying winter barley tonight and must have ran over ot with the sprayer on the tram line.

Guy in house messaged me, I said need to do something with that pipe but not sure who is responsible here?

Any ideas?

You sold the house off, so you created the easement, so its down to how your solicitor worded it. Chances are that unless you specifically stipulated that any damage by farming activities were not your responsibility, or put in a requirement for the new owner to lower the pipe depth at some point, then you're stuck with repairing any damage you do yourself, or lowering the pipe at your own expense. The new owner bought a house with a right to water, via the existing system, if you want that system changed then its down to you.
