Stopped by #CVU. Plant hire operator using a tractor to return, off hire plant. Reported to Traffic Commissioner. No tachograph installed, cutting corners on tax, drivers wages, tachograph regulations, storage, maintenance costs and financial standing.

That would never have happened before Brexit.

As an aside, if those bits of gear were off to dig in land drains for example, would that still be classed as agricultural work and be ok?

Probably not as more than likely the tractor is just being used for haulage. It would only be acceptable to transport them with a tractor if a) the tractor was also part of the drainage operation on agricultural land or b) you were transporting the digger and dumper to your farm or a farm you did regular agricultural work on to do land drainage.

Yes. However the Dumper in the photo is hard up against the headboard and it might not always be necessary to chain it to stop it moving forward as it probably couldn’t go forward when braking. I would think it very much depended on the design strength of the headboard. Personally I’d chain it anyway just to be sure.

If you look at the video in the link I posted above the official recommendation states the load should be secured enough to stop 100% of the load from moving forward and 50% of the load either sideways or rearward. You can use headboards if they’re strong enough and you can use the friction between the load and bed. In that video it doesn’t anywhere mention an overturn and I’ve never heard of it before either. I’ve had a C+E license since 1984 although to be fair I don’t use it regularly for work.

The roll over thing is a fairly recent interpretation of road laws IMHO

Can`t comment at all as I know nothing BUT sounds potentially serious. The "victim" would be well advised to make 100% certain the pigs are right on every count - sometimes one can be put in a worrying position by a jumped-up jobsworth who THINKS they know it all ! Worth checking!!

I think the point is the plant hire company is using a tractor to pick up and drop off their equipment to customers, what they are used for is irrelevant.

Might have misunderstood though. 🤷‍♂️

I'll not comment on the rights and wrongs of the load, but it's interesting that driver who is quite likely to be on a modest wage and is at the coal face is subject to the full force of the law at all times, yet the higher up the food chain you go, the less likely you get prosecuted and if you do, it's less severe relative to your income and responsibility
