I don't believe that is correct. People with pre 97 licences can tow greater than 3.5 ton on a B+E provided you use close coupled hydraulic brakes. Vehicles such as a discovery I and possibly II are rated to 3.9 ton towing weight in this scenario I believe. Definitely more than 3.5.
