Collecting debts

ive never ever gave him an invoice, whats the story with small claims court ? is it not one thing to win in court but another for it to be enforced ? when i left there i should just have taken a bit of machinery with me
total would be around 2k
Surely if you wre self employed you wouldnt receive wages, you would raise an invoice for work carried out.
What does your accountant/HMRC say about you having no invoices?

I did this a while ago on advice of my solicitor its called a lean it only works with certain things a trailer worked fine. When the chap called the police they called me and said I'd stolen it but I said I haven't as I intend to give it back when I get paid. After a bit of searching the police came back and said I was right and it was a civil matter and left us to it.


Its a " lien" perhaps Walter could enlighten us more

Can be throwing good money after bad. I put a guy through small claims court once, won the case and got a CCJ against him but no money. Naext thing I heared he could not get finance on a new van because of the ccj, month later he had the new van through some finance company. He had set himself up as a car valeting service doing an ace job. I got a mate to book mine and my brothers Discoveries, they were filthy, in for a full valet at a special rate of £90 each.

His face was a picture when I colected the second one.

With another guy who owed me for bounced cheques I ended up with a 6t Griffiths trailer , a haybob and about 11 acres of ploughing.
 
Tough one. Like others I`ve been both sides....needing payment & being unable to pay. First step...try talking to each other and sort out an agreement formally. If that doesn`t work or the agreed plan defaults then the gloves come off & its small claims etc.

How,unless there is a serious mishap in your life,can you ask someone to do a job for you,knowing that you can't pay.
Can someone give an example of why they can't pay?


Some times things are hard, I| can appreciate that, I don't mind if someone is making an effort its the ones that ignore you or give you bouncing cheques that I dont like

interistingly i done relief milking for a farmer with a reputation as a bad payer, but he needed me n paid promptly for a long while, he bought a mobile home n took on a polish worker, i could see what was going to happen, he still had not paid previous months invoice, i went to milk as usual one day, he told me my work was not good enough n he did not need me any more, i got straight in pick up n went home, wrote out up to date invoice nme n other half went straight back to him, he tore invoice up n handed it back to me, i said im not leaving without payment, he went in the house so i waited by his back door, perhaps 10 mins later 3 police cars with blue lights on went past, 2 mins later they came back up the road n into his yard, one police man talked quite firmly to me, i explained i was waiting to be paid, a police woman spoke to me, asked for invoice, she returned from house few mins later with a cheque

I bill everybody monthly and so far customers pay straight away on me handing them there bill or within 7 days.
one small cheque was slow coming a few yrs ago, so after they did pay 3months late I never went back again and spread the word to my mates and the customer had trouble finding anybody to work for them. you might as well sit at home on your a--e if your not getting money at least monthly.
fuel bills have to be paid monthly.

I cant understand why some contractors send an invoice yearly then wonder why they cant get the money out of the customer, surely a bill every month for a smaller amount is better (and more likely to get paid) than one invoice asking for a large amount at once.

I personally send all my invoices out monthly without fail, at the end of the day how am i supposed to put diesel back in the tank or pay people if i havent invoiced the customers?

As for offering to give them some free dental work - you obviously have plently of other income to survive on because i'd be very suprised if your workload doesnt go down when word gets round about it, afterall wasnt everybody saying on another thread about how certain people can become violent when dealing with customers??

Don't really care if my workload decreases due to threatening bad payers. Don't want to work for them again, or anyone else who doesn't pay for that matter.

its still not going to do your reputation much good sorting somebodys teeth out, even if they do deserve it
depends what type of reputation your looking for eg he is easy to muck about or better stay on the right side of him, its a choice but i know which one id want rather not have a few people not use me than 20 who do and not pay:sneaky:

On Thursday 26th September, we’re holding a webinar for farmers to go through the guidance, actions and detail for the expanded Sustainable Farming Incentive (SFI) offer. This was planned for end of May, but had to be delayed due to the general election. We apologise about that.
