Ditching

Under an AHA, where the landlord has provided field drains, should the tenant be expected to keep the ditches cleaned out?

Basically, the landowner provides the capital works and the tenant the maintenance. So, cleaning a ditch, yes. But dredging a river might be different is what I'd say. That's why we have land agents so both tenants and landlords can grumble about them and blame them.

When I got my first AHA tenancy, the outgoer had been dilapidated for not cleaning the ditches out. When I moved on, two years later, I had scoured just over a mile in length, by hand and had dug half a mile of new ditch with a machine. Hey presto, big lump of dilaps avoided! No wonder my wrists are trashed nowadays though.
