Historical field entrance.

Hi,

I'm not sure if this is in the right section, but is there a law on opening up an historic entrance into a field ?

i.e. if it has not been used for 80-100 years is this still legal to re establish.

Does the opening exist on the ground, or is there any indication for it actually being there, such as an old gate, rails/hurdles... anything basically? Hole in the hedge....

You could ask Highways at the local Council, but maybe best if you can compile all your evidence well before. Of course if the gate is there and you improve it for safety, such as widening it .... ;)
 
Lots of pics showing the post and a broken old gate would be ggod to have ;)

Clear it and hang a new gate in the opening?


Think it would even need a new post, cant remember the actual visual detail of it but put it this way there is not much physical evidence left.....

If it's on a map it should be allowed in my opinion,local footpath association are trying to extend a footpath here that was missed off definitive map in the 1940s as they have evidence it was used twice!! and looks like county council will do it

Given that the dog walkers here will cut a fence or hedge to create their own personal entrance to some of my fields, I would say crack on if it’s in the map.

Its on an historical one that's the issue, its not on the new/modern maps.

Maps are an indication, no necessarily proof.

I had a clip board merchant wandering around on my neighbour's ground. He asked if a ditch on the plan was still functional as it led from non-existant sheep pens to a major drainage ditch. I stupidly said, it wouldn't be used any more because the sheep pens were long gone. Of course, at the next storm there was a big pond! It didn't bother my neighbour but it did affect my road. My bad! He has refused to clean it because it's not on the plan so doesn't exist!
