New gateway to land

I wish to apply for an entrance to a piece of land to enable loading of animals to take place in the field rather than on the adjacent busy A class road. I currently open the fence to get them in and out.
I applied several years ago before I had animals in and was rejected, as a mature tree would have needed to come down to gain sufficient sight lines and for the supposed increase in traffic
The tree has since been felled due to decay and I can't see how pulling the transport vehicle off the road would be anything other than advantageous to every one.
Anything I can use in my favour would be gratefully received

I read a comment on the forum (can't remember who posted it), about putting in an underpass, and he said the highways said it was not needed, so his father walked the cows over the road, with 1500 cars stopped and waiting! Apparently it did not take long before the highways re considered!

I would be inclined to just put the gate in by the way.
 
On an A Class road I wouldn't JFDI, you only need one Planning Enforcement Officer to pass on their travels and them be in a bad mood and you could be looking at enforcement action.

Can you achieve the required visibility splays now the tree has gone? Each highway authority will have diffent guidance but I think if it is a 60mph road you should be looking at 200-250m visibility in each direction from 2m back from the highways edge. There can be no obstructions between 0.6 and 2m height within that splay.

If the OP is already taking the fence down, he is half way there to a gate... :)

Photos of the existing opening should be made showing the existing "gateway" to addf weight to any argument down the line.

They managed to get away with it on A48 up the road from here.
Goodness knows how .
Was a very small 9ft gate in hedge overgrown ,then opened out ,track put in few cones over the years, then eventually BIG main entrance now tarmaced and Farm shop ,new sheds,house etc etc.
Some have all the luck possibly or good connections???

The existence of a lawful entrance was their friend their I assume.
 
Thanks everyone for the replies. Yes there's a curb so will be applying to drop it and also for a pull in with the gate set back, so I can pull off the road to open the gate.
SJM, would it be good to remind them of their previous objections with the application, as the sight lines are now there, or save that for later ?

I would certainly highlight that the reason for objection has now been overcome.
