Basically any FBT/AHA tenant where you have to get the landlords permission to enter a new environmental scheme could have their application to ELMs blocked. I know our FBT has a clause that we have to get written permission to enter any scheme that is longer than the length of our tenancy and that is pretty standard in most agreements

the fbts i have say that i must aply for iaccs or sfp and maintain the entitlements and some agreement mention succesor systems
most landlords give permission for stewardship
those that do not will have to farm the land with out an elms the rent will be negligable
as there will be free import of maize into the uk undercutting the feed grain price crops and livesock will have to stand on their own feet or land will be abandoned

iho most land lords will allow elms

I think it highly likely that landlords collectively have been carefully lobbying to ensure they get as much of new regime as pos.
They'd be daft not to.

'Natural capital'? sounds very much like the landowners property rather than the tenants.

Yes most probably will but that isn't what the TFA are arguing against, there will be a number of landlords who have land out on a long term agreement that they'd rather have in hand and those landlords might use the clause to stop tenants gaining access to ELMs and forcing them to surrender the tenancy

All my neighbouring AHA tenants in the estate pay less in rent than they get in BPS! They can push off if they think they are getting a rent reduction before I get one on my FBT.
AHA should be based on the earning capacity of the farm. FBT is what anyone’s prepared to pay unfortunately .

so if on AHA and the landlord stops you claiming ELMS the rent should drop
I’m not sure they could or would. They’ve never stopped us claiming BPS or entering enviro schemes before .
If they did, then yes, it would impact the earning potential of the farm and would have to be taken into account in any rent review

Unless I’m mistaken subsidies have and are continuing to move towards environmental schemes, how will a landlord demonstrate he’s complying without tenants assistance. Result could be no subsidy earning capacity on the land.
