Replacing a building with a new one - planning

I've got an old steel framed storage building that i'm interested in replacing with a new livestock building.

If i keep the same foot print am i required to go through PP? It would be a 100' x 40' building and would be within 400m of a residential dwelling.

If it's the exact same footprint I am fairly sure planning is not needed and you should also be able to off set the cost of the building fully against tax if exactly the same footprint but do check that with your accountant as I am not one and rules do change.

If you contact planning they will tell you full permission is required,just get on and do it.!
But if you go for planning I believe you loose the tax relief benefits of direct replacement as tax offices do follow planning. Photo's before and after should be just fine. My local parish Councillors have all used retrospective planning when caught for new building works and got away just fine.

JFDI if there are no neighbours who will really mind, have a chat with them, explain why you are doing it.

Strictly speaking of course the old building was not livestock, therefore a new one within the 400m zone would need it even if it were on the same footprint.

Enforcement round here is so poor that I would not worry about that, even if they did discover and enforce, chances are that they would not enforce demolition anyhow just restrict livestock use.

It may be more awkward if you are having intensive livestock in there 52 weeks of the year.

The cattle would only be there over the winter but the nearest house is about 40m away. A lot of the neighbours around here have retired from the city to live out their idea of country life and are keen curtain twitchers.

I could possibly use the "general purpose" building to house a few stock over the winter period and see if i get any complaints. If i do then have to go PP there's a history of stock being house without issue in the past.

whats the building going to be used for ,is it for finishing or housing over winter ?

If it were here, I would definitely talk to the neighbours, allow enough time for a good chat, and then apply for planning, it is not hugely expensive or difficult and then everything will be fine. Otherwise, one comment to the Council may cause a lot of bother if they are that close.

That is, of course, you can't bodge the current building and repair it into spec.

South Northants are not levying on farm buildings, but thought that I read some other planners are doing so.

I replaced a pole barn with a steel building and had a visit from a planning enforcement officer from the council, he had checked on google maps and ascertained that the building was the same footprint and said not to worry as he wasn't concerned about it. Had a letter a little later informing me that as the building was in an AONB and within 6km of an airfield planning permission was required (the new building was a few feet higher than the pole barn it replaced).
Had a guy do the drawings and applied for retrospective permission and it was granted with no comments from the local council.
JFDI you are not committing any offence by replacing the building, besides the death penalty was abolished years ago ;).

Is replacement tax allowable? I thought only repairs allowable? I have a 60 x 90 pole barn I would like to replace. I guess it's not like for like though if I go steel framed
Get the various materials from different suppliers or on separate invoices and then who can tell where or which building has been repaired !

how would the replacing idea go on if I was to move the building completely?

I have 2 projects a telegraph pole building which is to be replaced by a steel frame in a different location. and a straw barn which is to be pulled down and re erected in a different place 100m from original position?
