this is the problem, it seems all to easy to get a TPO slapped on a tree then things get really sillyIn all seriousness Kev, if the tree belongs to the Ws, get a tree surgeon to certify it as dangerous (with that dead wood no-one is fibbing) then should Doris Deluded do something daft like try and slap a TPO on it, they can point to it being unsafe.

IIRC he was digging quite some distance from the tree, not sure wether any roots would reach that far, certainly only very fine ones if they did.Just ensure you did so with the intention of limiting damage to roots, hand cutting them where you break or tear them, and back filling with good soil and peat, not a mix of sub soil and top soil.
Also if you can prove that the remaining rootball is intact and what % was damaged, not sure of % but I'd image allowing 30%.
And which side is damaged and what the effects will be ie is stability affected?
Take photos, lots.
Normally if you show, you did a honest job and did your best to ensure the tree will be unaffected you'll be fine.
If the tree hasn't a tpo; your only concern is with the owner.
