Any good news to report on Telecoms Mast renegotiations?

Has anyone manage to get a decent result in a Telecoms Mast rent negotiation following the new act which considerably lowers rents? I have recently been contacted by the latest of many companies to deal with my mast rental, less than impressed with what they're offering. Had the mast for many years and has been a useful source of income.
 
Dale Park Tribunal sets the scene where rents are going, it was renewal , £1200 pa I recall. Def get a good agent like Fisher German or Batchellor Monkhouse - who understand telecoms and farming! If your lease is 54 Act protected or not will influence Operator renewal approach.

Can the farmer refuse to renew ? £1200 pa I be wanting if my land .

The operators are still trying to get their way i.e. pay an agricultural rent for a commercial site. £25-500 usually vs £5,000 - 10,000/year previously. There have been various test cases in the Lands Tribunal that have had mixed results & rulings, though none that really let them get their way.
  1. Get a good land agent on the case. Make sure they are CAAV members as there is a lot of good knowledge shared amongst the membership.
  2. Stall for as long as a you can - the old agreement rolls on at the old rent until you both agree a new one.
  3. Do not be concerned by any threats of compulsory purchase or having an agreement forced on you, but do have a professional look at any correspondence before engaging in any replies.
 
I’m sure you can spin it out for a year or so and delay it, plenty others and there will be more Tribunals that decide where the market goes. I doubt if rents will ever go back to where they were £5000 pa for GF.

Hmmmmmm
Wish I could get the same rate with no inputs per sq metre return for a couple of hectares as my mast yields yearly. Must be fifty quid per sq metre yearly.

If the original lease was drawn up without a reinstatement clause, I think someone has been negligent. Reinstatement would be very expensive.

Highly recommend Fisher German! They know masts inside out.

Are you at the end of your lease @Rufus?
To update on this, yes I've been contact with Fisher German. I can recommend they are very professional and knowledgeable. I am still in the negotiation process, seems to go away for months then suddenly pops back up. I'll keep this thread posted with any further developments.....

Why would you sign a new lower value lease, when you could have just let the old one roll over by 'tacit renewal' at the old rent?

Mine rolled over for years until they decided they needed a new lease to enable a mast height extension, which I was never going agree to at either the old rent (£3k), or their proposed new peppercorn rent (C £1k.), so they had to revert back to more 'traditional rent' agreement and new 15 year lease ;)
