Bought in heifer proves incalf

Sold 12 heifers in the local auction mart at the end of November and kept a few out of the same batch and noticed one of them aborting a very small calf then realised a couple of steers they were running with 1 of them was entire so wrang the buyer the same day and apologised and told him theres a possibility that some of them may be incalf and did he want to keep them and if so we would pay for the vet to go and inject them all. At the time he was very appreciative of the honesty and said since he is intending breeding with them it was no problem as they are 2 years old anyway so left it at that.

Buyer has been back intouch this week and said it looks like 3 are incalf and wanted to know what we are going to do about it?

Advice appreciated.

Remind him of the conversation and your offer which he turned down. I would be leaving it at that tbh.

I would say you’ve done your bit.
I’ve been on the receiving end of heifers being accidentally in calf and it’s not pleasant, particularly when you’ve bought them at 8 months old.
However in your situation above, you offered to rectify and he chose to take the risk.

Find out which rules apply, often the LAA conditions modified or not. That is the first place to look and often they do not provide for the protection you think you might have.

A few years ago we sold some 12 month old suckler heifers, the buyer came back to us ,said 1 was in calf, what do we do about it. We gave him his money back plus keep cost. The heifer calved normaly, and made a good suckler cow. Guess it was luck.

But in @westviewfarm6480 case he had already identified a possible problem early on and offered options to deal with it which weren't taken up.

Thanks all for the advice, i obviously feel bad about the situation and don't want it to be said around the local area that i sold them incalf etc but its just annoying how I've been as honest as possible about the situation we know the buyer aswell so obviously don't want to fall out

I suppose the question is does he want to fall out?
If he does, then find another buyer.
He will be back anyway

Ask him if you can have them back for the same money he paid but because he turned down your earlier offer your not offering any money for keep. He isnt worth keeping onside if he wants it all on his own terms

Interesting, I sold inlamb ewes and some lambed earlier than I said they would. I had the auctioneer on the phone to see what I'd do. It must depend who they like most the seller or buyer as to what they think is right.
 
Answering my own OP, I took the out come on the chin, and have never bought from that vendor again. DH the auctioneer wasn't very helpful.
Another mart heading eastwards on the same road are very much in favour of the buyer in these situations so much so it’s to buyers advantage financially if they are incalf at times
