Seen quite a number of random posts on here these past few days, about fellow TFF members who haven’t paid for stuff ....... :eek::eek:
More of it about than I would have expected!

Surely Scotching has a totally different meaning to welching. I believe it to mean fix

Eg, As the nails hit home they exited the other side of the stable door, his grandfather pointed to the protrusions with his stick and blarted "scotch them nails over or thay job will never last my boy"

I take it you mean "batter those over the head" by " scotched"?
As in "scotch" a rumour

Nothing is sold unless I have the cash in my hand or the transfer into my bank. Been there, done that and got a few tee shirts! Yep the older you get the grumpier and less trusting one becomes.

This is the right way to view it as thats what money is for - the currency to seal the deal, the "proof" of the deal.

An agreement/ handshake etc. can be the intention to do the deal but til the proper exchange then it doesnt and shouldnt mean anything. In the absence of payment it means one or the other of the parties wasnt happy with the deal and so it doesn't happen.

Payment by its very nature makes the difference
 
Agreed, but if nobody keeps their word , how will anything work.?

It does because most people do keep their word. Thats our moral code, society, hierarchy etc.. But until there is an acutal transaction is made we can only go on that. And sometimes it goes awry, generally not that often but it does and even then people havent lost out in the way they think they might

AFAIC if I shake someone’s hand, or verbally agree on something, then the deal is done, end of. I’ve always found most in the agricultural community work the same. Maybe i’ve Led a sheltered life?

I do know that if someone welched on such a deal, that I, and most other farmers that I know, would never forget it and the welcher wouldn’t get another chance to do it.

With a senior police officer in the family, I was brought up with a healthy respect for the law and, in my experience, the law usually follows commonsense (despite occasionbally acting like an ass!).

A legally binding contract has five characteristics. A hand shake or tacit agreement may simply be an agreement to make an agreement with the details to be specified later. One party may later find that those details are the deal breaker and may legitimately pull out. For a lot of deals, that probably doesn't matter. That probably is because there is no contract as there has been no consideration.

I once did a deal with a man who represented an oil company. I was happy to rely on his word but he insisted we put it in writing, adding, "You never know, I might drop dead next week!".

He did drop dead, but the company honoured the agreement because we'd had the sense to put it in writing. Would they have done so if it had just been my word?

I am not a lawyer and would have left it to those on here to explain, but maybe they have their eyes on their fees? Hand shakes are all very nice, but I will continue to follow up with a letter, "Just a note to confirm what we discussed....", if it's something important.
