Yet Another ELMS Thread

Hi,

Sorry if this seems a stupid question, but when a farmer is renting land, will there will a general rules which states whether the farmer or the landowner receive the ELMS payment? And if it is the landowner, will that mean the farmer will pay less rent than if there was no ELMS payment?

Depends on what you mean by 'renting'. If you mean short term grass lets, then no, the grazier will not be able to claim ELMS money, that will be purely for the landowner to decide upon.

Otherwise, only the person actively farming the land will be able to claim ELMS money, the same as only the active farmer can claim BPS. So an FBT or AHA tenant will be able to claim ELMS. Its unclear as yet exactly what rights tenants will have to claim ELMS money without landlord approval, its been stated that they will be able to, but how that fits in with the length of their tenancy, and the fact that some options will be irreversible (such as tree planting) is yet to be determined.

With regard to rent, once the amounts that ELMS may bring in are better known then one has to think that landlords will view that money as contributing towards the productive capacity of the land, and thus ELMS payment rates will be involved in setting rent levels.
