Following on from our telephone conversation this morning to clarifier the account, since October 2021 till 5th August 2022 total payments have been forwarded to you in the sum of £105,289.30.
The balances outstanding are agreed at £47975.98 from the previous straw delivered and £88924.40 in relation to the silage and produce delivered this season.
Going forward the payments that can be made are as follows
£25864.90 before 31st August 2022 ( part of this will be before however I cant confirm how much till tomorrow )
The monthly payments going forward split into 2 payments of £5500 on the 15th and 30th of each month.

Dear David Neil Dobbin, Brancote Farm Tixhall Stafford ST18 0XX
I write to you in regards to the outstanding monies you (David Neil Dobbin Brancote Farm Tixhall Stafford ST18 0XX) owe to myself Sarah Trevelyan T/A Proforage, the amounts are £47,975.98 outstanding from produce delivered in 2021 and £88,924.40 for produce delivered in 2022 Total outstanding is £136,900.38. You are in breach of the first contract in way of payment of £7,000.00 due on or before 10th of each month that has not been paid, you are also in breach of contract for the clamped wholecrop to the value of £8,242.50 that was originally agreed to be paid mid-August 2022 and then you extended it to 30th August 2022 and you have still not paid for it (YOU HAVE USED THIS PRODUCT IN ITS ENTIRETY FEEDING YOUR COWS). You are also in breach of contract for contract work carried out on your behalf baling straw for yourself as instructed to do so by you in July 2022, it was agreed you would pay for this work in full in August 2022 which you have failed to do so, the amount for this is £1,622.40. You are also in breach of contract for silage and haylage delivered to you in harvest 2022 as it was agreed you would pay £4,500.00 per month (made up of 2 payments one for £2,500.00 PM and the second for £1,500.00 PM and the full outstanding balance £88,924.40 of this by July 2023 which you have breached the agreement and have not paid the monthly instalments.
It became clear to me in the first week of August 2022 you had no intentions of paying the above monies and you have deceived and mislead me into allowing you to run up a bill now owing to myself £136,900.38, I wrote to you by way of email dated 7th August 2022 outlining the outstanding monies you owe. To which I received an email from yourself (dated 11th August 2022) with an amended payment plan to suit yourself to which I had no choice other than to accept which was you stated to “£25,864.90 before 31st August 2022 (part of this will be before however I can’t confirm how much till tomorrow)” TOMORROW NEVER CAME! You also stated “The monthly payments going forward split into 2 payments of £5,500.00 on the 15thand 30th of each month.”
I believe you have no intentions in paying me the money you owe to me, which now leaves me only one way to sort this situation out which is as follows.
1. I Sarah Trevelyan T/A Proforage DEMAND YOU DAVID NEIL DOBBIN TO STOP USING MY GOODS TO FEED YOUR CATTLE AND RETURN MY PROPERTY (FARM PRODUCE FOR THE SUM OF £136,900.38 BACK TO MY ADDRESS FIRS FARM MOAT LANE AUDLEY STOKE ON TRENT ST7 8HS IN PERFECT CONDITION AS IT WAS DELIVERED TO YOU WITHIN 14 DAYS FROM TODAYS DATE 2NDSEPTEMBER 2022 THE DEADLINE FOR THE RETURN OF MY PROPERTY IS BY 4PM FRIDAY 16THSEPTEMBER 2022.
No one including yourself David Neil Dobbin have the right to defraud myself Sarah Trevelyan T/A Proforage out of my property.
If my property is not returned to me by the 16thSeptember 2022, I will be reporting you to the Police and also instructing solicitors to issue court proceedings against you David Neil Dobbin and I will also be seeking costs, interest and compensation from you.
