Bought at Online Auction - No contact with seller

Back in September I bought 15 times 10 foot sheep IAE hurdles in an online dispersal sale via a reputable auctioneer.

I was give an email and a mobile number to arrange collection and also told best to whatspp them or email as where they work there is poor mobile signal.

I emailed and messaged a few times and not got a response other than once where the guy said he was away that week and not around for collection.

Since then no replies.

I have also spoken to the auctioneer a few times, even said just send me the address and Ill collect asap without the guys help but auctioneer unwilling to do that.

I spoke to them again on Monday and he said he was in the area and will pop in to see the chap, so I rang this morning to find out if he managed to touch base with the seller.

By all accounts the yard was deserted, no sign of my hurdles or the chap but sheep dogs in the house, yard empty of all stock but in a right state, all messed up and crap lying around.

Ive left 2 voice messages today and sent email and text, probably 20 plus messages now left.

Really could do with the hurdles next week as scanning ewes on off lying grass keep but Im beginning to think Im never going to see them.

Anyone ever come across similar?

Are the auctioneers liable and can I get a refund?

Has the seller sold everything after the auction to another party .
Has the livestock gone through a mart recently,
Have bailiffs been and taken everything to cover outstanding depts the seller hasnt paid .
Worse case ,has the seller had an accident away from the yard and no mobile signal to get help or even passed away .
Is it worth involving the police to go to the yard and investigate if the seller is there or not .

You would think Auctioneer's hold all money due to sellers UNTILL all has cleared and buyers received goods correctly??

I’ve sold stuff through the same auctioneer. I received all sale proceeds in a lump sum prior to collection of items.

T&C’s said collection within 4 weeks after payment unless other agreement. If not collected items retained.

So I am assuming he’s had the money.

I’ve made best endeavours to arrange collection but just can’t get hold of chap.

Bloody frustrating.

I'm guessing the hurdles around £200 just tell the auctioneers to move things along
a bit faster .Show evidence that you tried to meet terms
of the auction but were prevented from picking said items up.
If common sense fails seek legal advice .

15 times 10 foot IAE hurdles come to a bit more than £200.

Auctineers know the problems and have know for a couple months.

I would send an email to the Auctioneers tomorrow morning, detailing what you have stated above, if you have any dates include them.

Make the point that the Auctioneer would not provide you with the address details to collect the hurdles. Ask them formally, for their proposed action to resolve this matter with a very short deadline.

Tell the auctioneer that you have now got to obtain alternative hurdles.

Inform the Auctioneer that you require a full refund of any money you have paid, within 7 days, else you will take legal action to recover the monies from them, and that they should recover the money from the Seller.

I’ve sold quite a bit of stuff online through our local auctioneers and it always cracks me up the amount of stuff that doesn’t get collected!
