Have been told that you must accept water coming from higher ground, just as people downhill must accept water from you......unless you are someone who lives in a house built on a flood plain, in which case you're stuffed.
To the op, it's not your responsibility, they have to put up with it.

But to top it off, they tresspased onto my land, blocked off several run off points from a road/ track going across my land ,without telling me , leading to one hell of a mess ,with the track being washed away.

What does this ijit expect you to do with the water that drains from yoiur land onto his?
What does he do with the water draining from his land to land below him?
He is so perfect that there is no smell from his sh1t, so therefore there is no water flowing from his land onto others.

Chap near us had council turn up, apparently a householder at the bottom of his field had complained due to water running from the field and in to his garden, council bod asked if there were any drains that could have been damaged, farmer said no, so council bod reported back to the home owner... Sorry but tough, your problem as water is rainwater from up hill

If someone saw them doing it..... Bill them for reinstatement of the track. Jez, what's wrong with people, messing about with other people's lives and property!!

Criminal damage then. We've had this in our parish with new land owners from the smoke blocking buddleholes as they were flooding their land. Expecting Highways to sort it and remove the water and in some cases trapping their neighbour's in their homes by flooding the road. A gentle but firm approach usually works. As said, water goes down hill and if you are below it, you have to deal with it.

Thanks for all your replies,it's appreciated. Here's a text I just recieved from them ,after I told them how dare they tresspass and turn all the flood water down my track

"Sorry we didn't have time to contact you, evryone is so busy over the christmas period and we had to take some prompt action because all the water is flowing down our field and into our yard. The stream outside the house has burst over on about 5 occasions and there have been times when we are outside in the dark, late at night ,trying to control flood water around the house. We would like to ba able to find a way to resolve this in a neighbourly manner"

Their house and farmyard is at least 500 meters from my boundary, not as if it was flowing directly to their house!

Excellent, thank them for confirming that they blocked up the drain points, and expect a bill for the cost of repairs to the track.
Resolve in a neighbourly fashion...... They seem very neighbourly so far!

Was it impossible for them to dig a temporary ditch above their yard to divert the water?
I have been ditching today - creating a new ditch to catch some water before it gets to the main ditch as I cannot get near that one, just so there is extra temporary drainage. No one told me there was new nettle growth there - by gum they dont half bite!
