Spoke to a neighbour today who discovered he had been penalised for having more hectares on his claim than he had entitlements!

He has always had about 3ha more land than entitlements but he has now been penalised to the tune of a grand for this.
I always thought you can put down all your land and you will only get paid on the number of entitlements you hold. Seems the RPA are trying to dream up every way possible to frustrate us all.

As long as his "activated area" claim total didn't exceed his entitlements then he can show as much land as he likes over that. Personally I have always played safe and claimed activation on slightly under the total area of my entitlements.

Surely the amount of eligible land is irrelevant it is the number of entitlements you hold as that is what you will be paid for!!

But there is nothing in the rules saying that you can't have, say, 500 acres off land and 400 acres of entitlements. Your claim would show the full 500 acres each year but only up to 400 of them would be claimed on.

Me thinks the RPA system is severely broken!

I've been fined 5k for not having enough ecological focus area ... on my organic (exempt from efa) land.
I called rpa a month ago to point this out including field parcel numbers.
Still waiting any response whatsoever.
Nice - I have a oels to els transfer to do before bps 2016 application. Ever get the feeling that you are wasting your time.
So all in all, total stress I don't need.

I specifically asked one of the phone advisors about this point the other day when ringing about something else. She definitely said if you declare more eligible land than entitlements you just get paid on the entitlements that you do have, and there is no penalty for having more land at your disposal that you have entitlements. So I would advise your neighbour to get complaining!

Are you sure that he hasn't had a random field removed from eligibility and the penalty comes from that, and he's just assumed it because he declared more area than entitlements?

Would be good to know this and have in writing somewhere in the BPS Guidance. @RPA

If this is correct then it would spread the risk of overclaiming as in theory you are not activating individual fields.
How will this work in the case of inspections? I'm so confused now!

So if you had 200 ha of eligible land and only 100ha of entitlements - the inspector would have to survey all of your 200ha whereas previously it would only be the 100 ha you had activated? Or am I getting the wrong end of the stick?

If it is the case though, how much time and extra work will this cost RPA?!

I've been fined over £1000 for alleged over claiming like many above. Not at all happy. Vote Brexit and everyone at the RPA will get the sack. Nothing would make me happier.:)

I Too. sent 2 letters regarding inaccuracies as regards fields. Both times I gave them 10 working days to reply and have not heard a thing! I received my payment dated 29th of last month and have not yet received my statement.

I too wrote and emailed the letter, have heard nothing. My MP ( a farmer who hasn't been paid yet!) has now forwarded my letter with an accompanying letter.
No reply to that either....... And now we are all going to compound the problems by applying again before they have sorted their own shambles out.
Not holding my breath for anDec payment this year :(
