Legalities of towing

Anyone able to clear this up,from what I can make out I cannot go further than 100km/60mls from farm to pick up a machine with my Discovery and trailer unless I have a tachograph fitted,is this right?

DVSA do seem to be having a bit of a purge at the moment, not just HGV's, pickups and vans are getting pulled a lot as well. Some of these newer 3.5t pickups have pathetic payloads and many are bing caught out

who is the towing vehicle registered to if its a company or in the farm name then yes but if its in mr smiths name then its private use then no tacho that's how id play it if stopped

exemptions Vehicles or combinations of vehicles with a maximum permissible mass not exceeding 7.5 tonnes used for the non-commercial carriage of goods​

This would include the non-commercial carriage of any goods, such as a person driving a vehicle for their own personal use, for example, to move house or to transport goods as part of a leisure pursuit (for example, horses, rally cars or bikes).

Non-commercial carriage is defined as any carriage by road, other than carriage for hire or reward or on own account, for which no direct or indirect remuneration is received and which does not directly or indirectly generate any income for the driver of the vehicle or for others and which is not linked to professional or commercial activity.

Complex but I think you are correct that you need a tacho if over 3.5t max permissible weight which you will be as soon as a trailer attached.
It is as part of business use so that applies to you. It is not leisure activity collecting a machine.
You are exempt up to 100km. However, the chance of a policeman knowing all this is remote as the markets would be at a standstill checking all those who fell foul of the regulations.
However, having been to a DVSA/VOSA course they mentioned this. They are also good at pulling you over if the outfit looks a bit rough. So clean your windows, get a number plate and make sure lights work.

I've looked into this lately, and yes, you are right. But it is very difficult to police it, as oddly that 62 miles is not from your place of residence, its from where you started that day. It's worth noting before you run to get a tacho, most manufacturers dont offer a tacho fit, so you can't order a truck with a tacho... more importantly, the fines for not having a tacho are negligible compared to the fines of not adhering to tacho rules. So for me... I won't be fitting one

Builder or ground worker for example, can transport digger etc, and tools for work, and be exempt from above,

No the restrictions are the same for everyone. There is however small trailer exemption, as long as goods you're carrying are your own and unladen trailer weight is under 1020kg you're fine to crack on.
