Planning Applications, PD and the like (General Chat)

I have the 1968 Agriculture Act (s8) defining livestock as:

“livestock” means any creature kept for the production of food, wool, skin or fur or for use in the farming of land or for such purpose as the Minister may by order specify.

Damn! That is a good question, I literally have no idea how far it extends although we did get a building passed under PD for Deer.

Did that require anything extra than the standard 28 day notice? A 100ft diameter roundhouse for deer would fall under PD subject the normal distance and other tickboxes?

-edit- by "did that require" I mean, did they ask for things and you tell them it was PD so they could go away!?!

In which case, if you can put that definition to your use and quote the 1968 Agriculture Act then I can't see they have a leg to stand on.

No nothing, sailed through just like any other agricultural PD building. Ours wasn't a roundhouse just a standard barn but as long as your under the 1000sqm limit (still 465 in some parts) then the shape and design shouldn't be questioned.
 
@GeorgieB82 , I asked my council for some pre app advice (and paid) at the end of March, they aim to have done and dusted in 28 days, so far diddly squat.
I checked I'm on their system and they say yes, is there any rule that says anything about them dragging their feet?
Unfortunately not with Pre-App, there isn't any statutory requirements but I would be jumping up and down by now. Email the head of planning and state that although you are aware that there is no statutory time period you feel that having paid a fee that your request should be dealt with in a timely fashion.
When pre-apps used to be free there was no comeback but now they are paid for you should get a decent service.

We have recently (1 month ago) had a new shed granted under the new 28 day permitted development for a (850 sq mtrs @ £96) but have submitted another application (slurry pit) and it has been rejected by my local planning department as this would take my applications for the year beyond 1000 sq metres but they are totally unsure of the time scales another application can be submitted or whether there actually is a time frame since the rules changed!!!!!!
The trouble is this application had been on there desk for a fortnight and the FULL planning application they THINK they require is 2 months.
Would anyone know if my council are correct by rejection or not????? @GeorgieB82 ???? Many thanks

IIRC it used to be a 2 year gap between PD applications so if it’s still the same you will indeed need full planning.

The form you filled would normally say "has any development taken place on the holding within the last 2 years" or it used to,You only have permission to develop so if you have not started the work you should be ok if it works the same as part Q permitted developments as i have used this loop hole twice to my advantage

Have excavated the new shed site but not put any post holes in yet.

The timeframe is still 2 years. Before doing anything too drastic ask the council to put in writing the reason the PD permission was returned. It may be that the rules have been interpreted incorrectly and you can try again.
Otherwise it will be a full application which will take 8 or 13 weeks depending on the size of the pit.
 
I am looking at trying to get some plots but haven't come accross limits of built devptmt.
The NPPF says in general terms that the building of new dwellings should where at all possible be constrained to the limits of built development (LBD). Every Local Authority will have a definition of this depending on the geography of their area. Most South East Borough's have maps (usually online) with a boundary around each settlement, village etc. Inside that it is generally acceptable to build new houses. Outside of it is classed as countryside and new dwellings would be harder to argue.
There is a basic hierarchy of land to be developed:

1. Brownfield sites within LBD
2. Backyard sites within LBD
3. Greenfield sites within LBD
4. Brownfield sites outside LBD
5. Greenfield sites bounding the LBD
6. Greenfield sites outside the LBD
7. AONB'S
8. National Parks

Anything past 3 would require a very strong argument against local and national policy combined with a dire housing shortage in the Borough.

The Government National says-wants-encourages their policy and veiws.
The trouble is regional and cross borders Government interpret it differently and Local Authorities do what they like ???
Our local council defiantly does they passed planning for a 5 bed house with triple garage a year before they turned ours down which is on the same road due to that the traffic would increase and it's a single road we have horses etc so the traffic would be the same
