Redundancy

Just wondering if anybody has any experience with making employees redundant, nearing retirement and contracting out arable land has left us without the need for staff but having not made anybody redundant before we’re not sure where to go for advice! Both staff members have been with us for over 20 years. Thanks for any advice given.

Expensive but legal process is imperative.
NFU have legal people who can help with this if you are members.
If you are thinking of retiring and ending the business it is an easier process.

If you are NFU members, their advice on this is very good. It’s never a pleasant job, much less if they’ve been with you some time like that, but make sure it is done (technically) right, or someone will be helping them to claim unfair dismissal.

I think any contractor taking over has to give your staff a chance at a job.
Even so you should oay full redundancy unless they give a gurantee of taking over redundancy rights.
My solicitor advised paying full plus a tad even though my man was taken over with rights.

Our man left with the equivalent of nearly two years basic in his pocket.
I was still an arse:scratchhead:.
I tell you this only because I hope you realise that however decently and sensitively you handle this, you will likely still be the bad'un.

Thank you all for your replies, thought it would be best to consult a firm that deals with employment law. That’s what we will do, don’t want anybody getting/doing the wrong thing and making the horrible process worse for either side!

I wrapped up our diversification earlier this year and had to make 6 good men redundant (horrible, but had to do it) NFU callfirst were excellent in guiding me through the process.
.gov website has a simple redundancy calculator which is handy too. Solicitors can sometimes overload you with jargon and mights and ifs, which guaruntees them a wedge - worth it on occasions, but its much simpler if you're making all staff redundant, rather than needing to select some of a team. As I say, NFU were great in this regard, for no charge too.

At what point would one discuss the likelihood of redundancy due to retirement with the employees? A friend of mine had to do this and part of the deal was cheap or little rent on the tied houses for a period following reduncy. The employer felt it important to ease the process, particularly as the employees were quite long standing.

Perhaps should have looked into this before you contracted the work out?

Perhaps should have looked into this before you contracted the work out?
We haven’t actually got a contractor in yet it just seemed like that was the way forward as neither of the men are skilled and we are wanting to wind down what we do ourselves. Will need to speak to a lawyer before going any further, we just wondered what anybody else’s experiences of the situation were.

never made anyone redundant but have had to sack a few over the years

use a Specialist HR company, don’t mess about with the NFU (amateur) or even solicitor (expensive). as this is a very specialist area which will cost you a lot of money if you get it wrong

I can recommend a good company who I’ve used in the past if you don’t know one ? It’s not expensive if you do it right
