My 2017 data is all there, it's all completely wrong but there none the less !. I can even Create a 2017 claim and edit all my field data, but until my 2015 and 2016 claim is all sorted out as to if I'm getting payed or not what do I code everything as ?.
I can't use WO12- mixed woodland as all my trees are the same poplar.
I can't use SR01- short rotation coppice as the RPA have said it's not that even tho they said to use that code in the first place !.
I can't use RD-01- non agri BPS eligible which is what it actually is. But I can't use it as it wasn't claimed on in 2008 due to my late fathers death and everything being in the transfer to me phase IE I didn't get issued an SBI till July ish 2008 due the RPA dragging there feet.
The only other code is ND04- scattered trees but with 1100 to the ha and 13 ha worth there hardly very scattered !.
I just can't win what ever I do !.
As per previous discussions with you and the post by Hindsight, everything about your claim is absolutely right bar the one thing. i.e. not being able to show establishment of entitlements under SPS in 2008. But I am unsure, did you ever establish those entitlements or use those fields under SPS, even if it was after 2008? If you did then I think you could possibly appeal on the grounds of delay due to external circumstances (i.e. your fathers death). If you never established or claimed under SPS for those FWPS areas then I think you are never going to establish them under BPS. To me its pretty clear cut and your agent should have realised this from the outset.
In my own case, after masses of time and effort, I have successfully got the BPS entitlements established for all my FWPS land claimed in 2008 under SPS under land use SA02 and am now in (hopefully) the final phase of getting RPA to change their maps to show the areas as being BPS eligible usage of RD01 or SR01 rather than the WO12 that they currently map them as. Incidentally, I had to get a Forestry Commission officer to confirm that my FWPS land was still under FWPS rules, even though the payments have now finished and also to confirm that my usage of my poplar plantations as wood fuel, harvested as logs every 10 years or so was allowed under FWPS rules. This last thing arose because RPA define short rotation coppice as being a harvest interval of less than 20 years but Forestry Commission define short rotation coppice as being harvest interval of less than 5 years. Obviously, having issued the entitlements RPA have sort of admitted that the land is eligible but it looks like one department hasn't told the other to change the map status. In amongst all this, I still haven't actually received the 2015 payment, have received 95% of the 2016 payment and cant fill in the 2017 forms until they change the maps. I have taken the 2015 payment matter to the Appeal Panel in an attempt to force their hand and bring the whole thing to the top of someones pile; I will keep posting as that progresses.
I cannot understand why the rpa inspectors cannot look at google earth and see if the fields under cloud exist
all my fields show up with each date run on google earth since the year 2000 we are now in 2017
and in some case where fields have not been amalgamated are identicle to the os plans back to the Victorians or in one case a field that was subdivided ubder enclosure act is now back to the original in 1780
or why not run the satalight on another day
this would save a large amount in administration
In desperation I sent off my £250 about a month ago and appealed the 2015 decision. Actually, they never made a decision, just didn't pay! They refused all payments on land that was in Farm Woodland Premium Scheme by changing my field use codes from RD01 and SR01, after I had submitted, to "Natural Woodland" and BPS ineligible.
No correspondence at all from the appeal panel, but out of the blue I have been paid an amount that looks like the 2015 missing payment, plus return of their "fine" for over-claiming. it doesn't look like they have cashed the £250 cheque for the appeal either. The remittance advice has no details on it other than "2015 claim", no letter of explanation either.
I am guessing that they don't want to admit to this being a "lost" appeal, so I wont ever get any formal response otherwise that would mess up their statistics. But I am pretty convinced that release of the funds has come from lodging that appeal; nothing else has worked over the last 2 years!
They did correct the 2016 claims and made the correct payment in January.
All that's left to do now is to wait for mapping to correct their errors on the same fields on the 2017 forms, now that I have submitted my third set of RLE forms. The LAND section is showing the exclamation mark now, so that indicates changes pending. Lets just hope that they make the right changes!
