Countryside stewardship extension offer

Is it a 10 yr ELS scheme? We were in ELS for 15 yrs until 2017..The rest of the country had to renew with CS schemes 6 yrs ago.. very odd.. please confirm why? HLS was 10 yrs hence why agreement up for renewal even in 2022..
Unless an extention was granted why isnt ELS now CS??
I’m not running NE.
CS isn’t very exciting to me

No break option in the original agreements. My second one ran from 2002-2012 NE are still trying to enforce it. . . .it happens, it is happening.
Until such time as these long outstanding disputes are properly resolved “ you need to be very careful with whom you are dealing.”
(I don’t intend to comment on this particular thread again.)
My first agreements had a 5 year break option

Yes mine had 5yr break options aswell which must have run out when we joined CS.. i just never remember being allowed to just keep going with ELS in 2017 because they wanted everyone to join CS mid tier or Higher Tier at that point and another 5yrs has passed since then.. HLS obviously might have a few more years to run including extensions.. The feeling for most farmers is mutual about NE!

I got email today about 't&cs' of stewardship...nae effect me...BUT...then went on 'rabbiting'....my take was if you're in an agreement you could opt to take out another to starting 2024...effectively cancelling your current one and starting anew as long as the replacement was of 'higher enviro. value"

anybody else have email/ feel the same?

Ask the RPA as they change the rules as they go along
The RPA MIGHT tell you if any penalties would apply to the extended 5 years or the whole 15 years.
What would be good, is to have independent legal advice on how Natural England could potentially apply restrictions/ designations to land that has been in an agreement for 10/15 years through extension compared to having consecutive short agreements.

Does it matter if you are doing what you signed up to do and they pay the agreed amount?

Or is the issue uncertainty as to what needs to be maintained or the timescales?

The main issue is that renewing would mean having concurrent agreements compared to one long agreement if it is extended.
Although in practice it seems the same thing, I think legally they differ as technically you regain control and management for the brief moment between 1 agreement ending and the next beginning. This would make it unlikely that they could change a designation of land due to uninterrupted change compared to 1 extended agreement.
I don't know, it just worries me.

What I do know is;
This year I have been given many quotes to supply goods. Some have been valid for a few weeks, some for days and some for only hours.
Who the hell else [other than a farmer], would contemplate agreeing to working to quote given 10 years ago and lasting another 5 years!!

Yes it is a very fair point but once ELM,s is complete we can sack it off... its just temporary insurance to continue these schemes in the current climate

I am concerned that, if RPA successfuly claim that there is a breach of an EXTENDED agreement, they could impose penalties right back to the start date of our original agreement in 1998.

How is it possible to avoid this possibility? I am happy that RPA might be able to go back to the start of a NEW agreement, but not that they could go right back to 1998.

An earlier post refers to a MIRROR agreement? What does this mean? Is it just another name for an EXTENSION (which is now being offered) or is a brand new agreement with identical terms to the previous agreememt, with a break between the old and the new agreements?

Has anyone any experience of a brand new agreement (not an extension) which would therefore limit the RPA's ability to go back further than the start date of the new agreement?

To clarify

By "brand new agreement" I mean a new agreement with identical terms to the previous (expiring) agreement which would therefore mirror the expiring agreement, but actually be a brand new agreement
